The patents (which haven't been granted yet afaik) are for specific maps of motion to action. (eg pinch to zoom). Synaptic has their own set of mappings (EGR - http://www.synaptics.com/solutions/technology/gestures/egr) which they could have included, if they wanted to pay the licensing. (Or
