I've just switched to wired headphones. The Turtlebeach headphones, while still needing charging, are really good, for only about $60 and they last about 16 hours.

I've already got a free replacement of the earbuds themselves, from Apple, without having to use my Applecare, so there must be a well known problem with them. Maybe try that avenue if you can get to an Apple store.
