Nope, you might get a refund from google, but technically it's not their responsibility anymore, you would need to get into contact with Fedex and call their complaints hotline or what ever they use for such cases.Greetings Moritz.

The Google Home Mini will instruct you to download the Google Home app to your phone. Go get it. The setup is incredibly straight forward as the app will guide you through every step of the way.

If you got a mini, there's a mute switch on it you can use if it's actually starting to bother you. Not sure about the other models, but presumably those would have them too.

Unfortunately not. For the safety of its users, Google disabled the touch to talk ability after a discovered flaw in the mini actually was making it maliciously record, because it kept registering phantom touches. The best you can do is have the audio

Incidentally, the time it does record anything other than queries seems to be miscues. Which is why if you have the sound alerts on, it can really do a number on your awareness of when miscues actually happen, because they happen more than you might expect
