I think that's a pretty narrow interpretation of "deny".

Definition #2 of "deny" from dictionary.com reads "to refuse to agree or 
accede to: to deny a petition", but definition #3 reads "to withhold 
the possession, use, or enjoyment of: to deny access to secret information".


I think returning NODATA falls under definition #3.


As we have had absolutely no clarification from the Original Poster
as to what the  he was on about, I suggest speculation on this
point is moot.

Would using response-policy zone filtering to alter MX queries suffice?

Not with a regular BIND 9, no - at least not that I'm aware of.
I guess it can be done by hacking the source code, but is it worth it?
