I think in general you need a license to transmit anything.

Afaik certified GSM phones have been exempted from this
requirement. However, if you modify your phone then you need to
re-certify it. This can cost a bit more than you can afford.

What is "illegal" in it? As I know in many countries (except the UK) it
is really legal.
But I think that the law such exists in the UK break the main human
rights (such as privacy), am I wrong?
P.S. I ask that question because it is interesting to me to creat a
system which will possible to change IMEI "on-the-fly" when I incert in
my phone another SIM-card, for protecting privacy and against
governmental spying after citizens.

Not really unless you replace the non-free GSM stack with something like
osmocombb maybe.
