Edsall Washington Post Staff Writer Thursday, May 17, 2001; 12:42 PM The Senate Judiciary Committee today rejected on a partisan tie vote the controversial nomination of Theodore B. Olson to become solicitor general, but the Senate Republican majority leader is virtually certain to seek to bring the nomination to the full Senate through a discharge petition. Olson, whose nomination has been slowed by allegations that his testimony to the committee was evasive and lacked candor, was strongly defended by the committee chairman, Sen. Orrin G. Hatch (R-Utah). Hatch told colleagues, "I have not seen any discrepancies or inconsistencies in Mr. Olson's testimonies and answers." After the vote he denounced "some" Democrats, contending they viewed the vote as "payback time," referring to Olson's successful representation of the Bush presidential campaign before the Supreme Court in the election-determining case Bush v. Gore. Sen. Patrick J. Leahy (D-Vt.), the ranking committee Democrat sharply criticized Olson's testimony in which he disassociated himself from the controversial "Arkansas Project," an investigation of Bill and Hillary Clinton's activities in Arkansas conducted by the American Spectator magazine and financed by $2.3 million from foundations controlled by wealthy conservative Richard Mellon Scaife. In a letter to the committee this week, Olson reiterated that he had no knowledge before the spring of 1997 of the project. But former Spectator reporter David Brock has disputed that, saying that Olson was present at discussion of the Arkansas Project stories. Leahy had sought a bipartisan committee inquiry into inconsistencies in Olson's testimony, documents that raised questions about the veracity of Olson's statements and former officials of the American Spectator who dispute Olson's version of events. "This is not a question of illegal conduct," he said. "I just want to know if he [Olson] is truthful."
