Moose's inside account of the Washington area sniper manhunt has been posted for preorder sales on the Internet, despite a ruling from the county Ethics Commission that he halt work on the project. E.P. Dutton, Moose's New York publisher, has listed the book for sale on the Amazon.com Web site, although state and federal courts have yet to rule on his legal appeals of the commission's decision. Commission members were reluctant to comment, citing the pending litigation. Two County Council members, however, said that Moose's decision to list the book for sale raises questions about whether he should remain chief. "I think he's clearly jumped the gun," said council member Phil Andrews (D-Gaithersburg), who chairs the county's Public Safety Committee. "When you have an appeal underway and it's not been decided, I think it is a problem that he's going out to sell the book. . . . I think its grounds for us to begin considering whether he stays as chief of police." The appearance of the chief's book for sale has further complicated an already complex situation, said council member Mike Knapp (D-Upcounty), who also sits on the Public Safety Committee. "The fact that a book is listed is really unfortunate," Knapp said yesterday. "It really begins to force our hands." Knapp and Andrews said they believe it is now up to County Executive Douglas M. Duncan (D) to decide what action, if any, to take in response. Duncan spokesman David Weaver said yesterday that Duncan has "stated repeatedly that he supports the chief's desire to write the book and to appeal the Ethics Commission's decision. As long as the matter is in litigation, we're not going to comment." But at this point, Knapp said, that may not be enough. "If [Moose is] boxing us into a corner," he said, "we're going to have to respond." The chief's wife, Sandy Moose, reached at home last night, said that neither she nor her husband wished to comment. In his federal lawsuit, Moose contends that any attempt to prevent him from writing the book, scheduled for release in October, would violate his First Amendment rights. The publisher began soliciting orders of "Three Weeks in October" despite a series of efforts by the Ethics Commission, and by Moose's law enforcement colleagues, to persuade him to rethink his plans. The commission weighed in formally on March 20, saying that Moose's request to pen a book, and to consult on a movie project, violated "bedrock principles" of the county's code of ethical conduct, which forbids employees from exploiting the prestige of public office for personal gain. The first hints of disapproval from the police chiefs and federal agents who worked alongside Moose during the sniper investigation came two weeks after he announced his plans. It centered on concerns that a book would undermine the trials of the two sniper suspects, the first of which is scheduled for October, when Moose's book is due in stores. (Moose's is one of several books about the sniper case in the works, including one by reporters at The Washington Post. That book, scheduled for publication in September, is also listed on Amazon.) On Feb. 5, when the FBI invited the members of the sniper task force to Quantico for the first comprehensive review of the case since arrests had been made, several of the chiefs expressed deep concerns about Moose's literary ambitions, according to two chiefs who attended the confidential meeting. "There's been so much publicity in these cases, and so much has been said, that we were all worried it could start confusing the issues," Henrico County Police Chief Henry W. Stanley said. "With all that's happened, we certainly don't want anything to jeopardize the trial. I felt, and I think the group felt, that we needed no more publicity that could add to the trial issues." Moose did not attend the February meeting, but Stanley said the task force members asked Montgomery County Assistant Chief Deirdre I. Walker to relay their disapproval to Moose. "It was a unanimous recommendation," Stanley said. Walker declined through a police department spokesman to be interviewed. Moose addressed the pretrial publicity issue in March, when he told members of the Ethics Commission that he would have the book vetted by prosecutors, and he was offended by any suggestion that he would in any way compromise the case. Commission members declined to comment yesterday, but in past interviews they have warned Moose not to ignore their decision. -Caveat Lector- http://www.thescotsman.co.uk/index.cfm?id=655182003 Vanished into thin air IT IS eight weeks since Tariq Aziz, the former Iraqi deputy prime minister, gave himself up to United States forces in Baghdad. A powerful man, he was a familiar face in the corridors of power around the globe, one of the few Iraqi leaders whose name was as well known outside his own country as inside. But since he surrendered on 24 April, Aziz has disappeared. He is not alone. Out of a list of 55 of Iraqs most wanted senior figures published by the US defence department, 29 were in custody as of yesterday. They have also vanished from public view. Ask where they are being held, in what conditions or what will happen to them and the shutters come down. The Foreign Office, in London, is extremely reluctant to say anything about what is happening to Aziz or any of the others. The Americans are equally vague. And so keen are the coalition to avoid talking about the subject that they have told the International Committee of the Red Cross (ICRC) not to talk about the subject either. All that organisation can say is that staff have visited several hundred prisoners in and around Baghdad, including some of those on the list of Iraqs most-wanted. They probably shouldnt even have said that. In effect, 29 of the most significant people in Saddam Husseins regime have been cut off from the outside world while intelligence officers attempt to persuade them to divulge what they know about the workings of the old dictatorship. There has been much speculation about where they might have been taken, but the truth is that most are still in Baghdad, held in US custody while the coalition tries to work out what to do with them next. Despite a lot of positive noises coming out of Washington about the intelligence value of those in custody, they do not appear to be making much progress. Aziz, for example, was the man the US hoped would lead them to Saddam and the weapons of mass destruction. He was the man who could spill the beans on the Iraqi regimes innermost secrets. When he surrendered, there was talk of deals having been done, maybe in exchange for a new identity. If that is the case, it is taking a very long time. His family are apparently in Jordan, but according to Bill Rammell, the parliamentary under-secretary of state for foreign and commonwealth affairs, Aziz is in Baghdad. Answering a question from Tam Dalyell MP in an evening debate on 4 June, he professed himself "extremely grateful" for the chance to shed light on the mystery of the missing prisoners. Referring to a written answer from Mike OBrien, the Foreign Office minister, he noted that the "coalition partners have had the opportunity to interview Mr Aziz on a number of topics and this will continue". He was also able to state that Aziz remained in custody in Baghdad and that the ICRC had been notified and given access to the detention centre where Aziz and other detainees were being held. "We are trying to establish what medical treatment the detainees are receiving, but I can assure members that all prisoners of war are being treated in accordance with international law and the Geneva conventions," he added. Mr Dalyell, however, did not just want to know where Aziz was being held, but what was going to happen to him once coalition partners had run out of questions to ask. "It is too early to determine the nature of any criminal charges that Tariq Aziz and other Iraqi detainees might face," replied Mr Rammell. But it was not for the British government to bring those charges, he added. Instead, the coalition was hoping that the Iraqis themselves would take on the task of trying their former leaders. The rest of the answer provided an intriguing insight into the coalitions thinking. If Aziz and the others on the list thought that they might buy their freedom by surrendering and trying to cut a deal with their captors, they appeared to be out of luck. It was not victors justice, insisted Mr Rammell, but - citing the discovery of mass graves - the Iraqi leaders most responsible for genocide, crimes against humanity and war crimes should be brought to justice as soon as possible. "There are strong arguments for allowing the Iraqis themselves to bring to justice those who have committed crimes against them, and we will need to see what sort of investigative and trial processes they can adopt," he said. "Iraq will need international help to rehabilitate its justice system, and we are willing to play a part, together with our coalition partners, in achieving that end." All of which offers some small insight into the fate of the big guns of the Saddam regime, but no fine detail. Whether they are being kept under some form of house arrest in one of their old leaders many palaces - as has been suggested in some quarters - or whether they are firmly under lock and key in a Guantanamo Bay-style detention centre is not a subject anyone

In an effort to stop this punitive legislation, the Alliance for Natural Health, an organization based in England is planning to file an emergency lawsuit on behalf of consumers, vitamin companies and health food stores to overturn the EU Food Supplements Directive which became law on June 10, 2002. The Food Supplements Directive currently concerns itself only with vitamins and minerals. However, by the year 2007 the European Union will be obliged to provide detailed proposals to expand the law to cover all other types of nutrients. Eventually this will force vitamin companies to reformulate their most important supplements. Although the 13 key vitamins would be permitted, the Directive excludes the most bioavailable forms of vitamin complexes. For example, The Food Supplement Directive bans any chelated or other organically complexed mineral forms such as selenomethionine. Additionally, it will only allow the alpha-tocopherols of Vitamin E but excludes the complete tocopherol range as found in nature (including the lambda-tocopherols) which are far more effective as antioxidants than the simpler alpha-tocopherol group. Research has proven that many vitamins and minerals are most bioavailable when in the forms found in nature. But it will be more than the distillation of five decades of treaties into one document. For 16 months, Europe's most important and exclusive club has struggled to draft its first constitution. The process has been awkward and unpredictable, ambitious and timid, as delegates from the 15 member nations of the European Union and the 10 that are to join next year fight to protect their countries' national interests even as they agree to cede bits of sovereignty. Philadelphia it ain't. The founding fathers came together in 1787 for a Constitutional Convention to forge a document that created a national identity and institutionalized the sovereignty of the American people in one nation-state. The 105 delegates who made up the Convention on the Future of Europe tried to do something much more modest: codifying common ground among long-established states that will give their union more of a logical structure - and perhaps more power - as they expand eastward. Until now, Europe was mainly associated with a common market, Ana Palacio, Spain's foreign minister and a delegate representing her government, said in an interview. Now Europe will be more and more a place of citizenship. Now people will associate Europe with a constitution. Indeed, one article in the draft constitution states, Every national of a member state shall be a citizen of the union. When the union expands, that means a mega-Europe of 450 million citizens, larger than any population mass except for China and India, and an economy of more than $9 trillion, close to that of the United States. The proposed constitution also states that European Union law will have primacy over that of member states. It simplifies voting rules and spells out areas like trade policy in which the union will have full authority and other areas to be shared with the member states, including justice, transportation and economic and social policy. It will also set up a new structure for an organization that was created for only 6 states and will soon have 25, with two permanent presidents, one foreign minister, a stronger administrative arm and a Parliament with expanded power to pass more legislation. But for many participants in the process, including Giuliano Amato, a former Italian prime minister and a constitutional law expert who is one of two vice presidents of the convention, the proposed constitution is lacking because it fails to create a common foreign and security policy. I'm not entirely satisfied, he said in an interview. Too many member states are defending themselves instead of sharing power at the European level to make things better. It's each state beyond the constitution. That's why I'm not even sure we are entitled to call it a constitution. [On Friday, despite deep disagreements within the delegation, Valéry Giscard d'Estaing, the former French president who is the convention's president, told the final plenary session in Brussels that the convention had adopted a historic first draft. The forum rose for the union's anthem, Beethoven's Ode to Joy, and toasted their endeavor with Champagne.] With over 400 articles, the constitution is very much a work in progress. Mr. Giscard d'Estaing will present it to a summit meeting of the member heads of state in Greece next week. Then, in October, it will go into intergovernmental review, in which each member state has the right to demand changes. Each parliament - including those of next year's 10 newcomers - must ratify the document before it comes into force. Some countries, like Ireland and Denmark, will have national referendums - as required by their constitutions. Even the pope has weighed in, lobbying - thus far successfully - for a specific reference in the text to God and Europe's Christian heritage. After all, the union's debt to the civilizations of Greece and Rome and later by the philosophical currents of the Enlightenment are mentioned. One of the main challenges to forming a more perfect European Union is one that the American founding fathers confronted: how to find a way for big states and small states to share power. France and other big states would like a strong president from a large country who would reflect their views, an idea that is anathema to the smaller states. Spain has vowed to fight to retain complex voting rules that give it power disproportionate to its population. But I believe it would be impossible for Gates net worth to exceed todays trillion dollar budgets. Still, it has been recently estimated that Gates is as wealthy as the bottom 100 million Americans combined. Looking over the list, I think the most interesting aspect of the list is how many of these successful entrepreneurs were immigrants, their sole baggage on the long ocean voyage little more than a large dream. Andrew Carnegie, John Jacob Astor, Stephen Girard, Alexander Stewart, Frederick Weyerhauser, William Weightman, Claus Spreckels, Anthony Brady, Adolphus Busch, John Kluge, Joseph Pulitzer, Samuel Slater, and August Belmont were not native-born Americans.
