Mikhail Khodorkovsky, the chief executive and principal owner of Russia's largest oil company, Yukos, was arrested and charged with tax evasion, fraud, forgery and embezzlement. Mr. Khodorkovsky now awaits his fate in a Moscow prison, where prosecutors can hold him for up to two months while they decide whether to pursue a trial. But his arrest has already raised profound questions for post-Soviet Russia. It has exposed the complex and deep divisions within the elite and the public alike about the nature of state control over the economy, the role of big business in politics and the influence of personal wealth in what still is a poor society. As regards the charges against Mr. Khodorkovsky: it is likely that in the 1990's he broke some laws. But in the chaotic Russian economy of the time, when the state was privatizing its assets on a grand scale, no large business in Russia was "clean" and the larger the company, the greater the chance it committed violations. For example, full payment of corporate taxes amounted to well more than 100 percent of most businesses' profits. Tax evasion was the only strategy that allowed an entrepreneur to pay salaries and invest in his business. Yet the choice of Yukos, among dozens of equally unsavory candidates, as the scapegoat for the misdeeds of the 1990's makes little sense. In the past five years Yukos has traveled the furthest of any post-Soviet industrial giant from the mores and practices of the previous decade. In 1999 Yukos became the first major Russian oil company to release its quarterly results in accordance with international accounting standards. Independent directors are a majority on the company's board. When Mr. Khodorkovsky took over the company in 1996, Yukos suffered from the same problems that were hobbling the rest of Russia's energy sector: with costs mounting and oil output declining, the company was on the brink of bankruptcy. Yet by last year, Yukos accounted for 18 percent of Russia's total oil production, pumping an average of 1.4 million barrels a day. Helped by higher oil prices, the company had enough cash to become the first Russian oil company to pay dividends to its nearly 60,000 shareholders. This generosity has extended to the public as well. Yukos's and Mr. Khodorkovsky's personal donations are beyond parallel in post-Soviet history. Yukos gave $45 million to charity in 2002. When the billionaire investor and speculator George Soros decided last year to end a decade of charitable giving in Russia, Yukos contributed $1.15 million to the Eurasia Foundation for the support of small-business and community development. In March 2000, Yukos started a nationwide program called "Pokolenie.ru" (or "Generation.ru") to provide Internet access to Russian high school teachers and students. Pokolenie.ru equips centers where teachers can acquire Internet skills to pass on to their students. Their travel, room, and board are paid by Yukos. By last spring, 56,600 Russian educators had completed the course. This hard work has increased Yukos's profits and Mr. Khodorkovsky's enormous personal fortune. But it profits Russia as well. David Wurmser, a neoconservative scholar known for his close ties to the Israeli right, was appointed in mid-September to join the team led by Cheney's national security adviser, Lewis "Scooter" Libby. In recent years Wurmser, who boasts a complex network of relationships to a variety of pro-Likud think tanks and activist groups, has frequently written articles arguing for a joint American-Israeli effort to undermine the Syrian regime. Wurmser's appointment sheds light on the prominent role played by Cheney and his national security staff in shaping foreign policy and coincides with the deterioration in the relations between Washington and Damascus. In recent months, Washington has accused Syria of sheltering Iraqi leaders, weapons and money and of allowing terrorists into Iraq. The administration backed Israel's recent bombing of a suspected terrorist training camp in Syria and dropped its objections to a congressional bill that grants the president the right to impose sanctions on Damascus. "The vice president undoubtedly chooses staff whose views are compatible with the policies of the administration," wrote Judith Kipper, a Middle East scholar with the Council on Foreign Relations, in an e-mail to the Forward. "The question is, how does the vice president's [national security staff] function in relation to the president's national security staff and how important policy decisions are made in the White House. While the vice president has a critical role to play, the secrecy surrounding his unusually large foreign-policy staff raises many questions which the American public needs answered." Cathy Martin, a spokeswoman for Cheney, confirmed that Wurmser had recently been hired, adding that he is serving as one of many foreign-policy advisers to the vice president. She declined to comment on questions about Cheney's or Wurmser's ideological leanings. Before his appointment, Wurmser had served as a senior adviser to John Bolton, the undersecretary of state for arms control and international security and one of the sharpest critics of Syria within the administration. In speeches and testimonies over the past year, Bolton has sounded increasingly alarmist far more so than the intelligence community about Syria's weapons programs. Wurmser's appointment was first reported by Inter-Press Service and elicited criticism from the Arab American Institute, an advocacy organization. Wurmser is the main author of a 1996 policy paper drafted for then-Israeli prime minister Benjamin Netanyahu by a task force composed of neo-conservative scholars. And if God is also the God of the Jewish people then the Deluge in 2239BC was the first Time Cross Over. Meaning that the Book of Genesis, from the first and including the ninth chapter, seems to me to be speaking of the other world, that is Earths twin, now called Hades. And so Adam, I say, was created as the first man in the other world of four dimensions, and a world within our own Earth, a world with a 360 day year. So 3.5 years, that is time, times and half a time is 1,260 days, a very important number in Scripture. Thus Adam, who lived most of his 930 years of 360 days, as a fallen man, lived, according to our own Earthly year, some 916.667 years or 11,000 months before dying. So from Adams creation as a living soul, the first man in the other world and equivalent to 3,871BC in our world, there is nearly 1,656 years x 360 days or 1,632 or our years to the start of the Deluge in Adams world and equivalent to 2239BC. For God had decided that as the lower world was full of wicked people, except for Noah and family, he decided 120 years before the Deluge to destroy the people. Chomsky, attending a Latin American social sciences conference in the Cuban capital Havana, said that since the September 11 attacks the Bush administration had redefined US national security policy to include the use of force abroad, with or without United Nations approval. "It is a frightened country and it is easy to conjure up an imminent threat," Chomsky said at the launching of a Cuban edition of a book of interviews published by the Mexican newspaper La Jornada, when asked how Bush could get re-elected. "They have a card that they can play... terrify the population with some invented threat, and that is not very hard to do," he said. After the "disaster" of the US invasion of Iraq, Bush could turn his sights on Communist-run Cuba, which his administration officials have charged with developing a biological weapons research programme, the Massachusetts Institute of Technology professor of linguistics said. Chomsky said the military occupation of Iraq, to topple a "horrible monster running it but not a threat to anyone," was a failure. "The country had been devastated by sanctions. But he never got to display his sign for Bush to see. As he stood among milling groups of Bush supporters, he was approached by a local police detective and told that he and his sister had to move to a free-speech area for protesters, on orders of the U.S. Secret Service. He pointed out a relatively remote baseball diamond that was enclosed in a chain-link fence, Neel recalls. I could see these people behind the fence, with their faces up against it, and their hands on the wire. It looked more like a concentration camp than a free-speech area to me, so I said, `I'm not going in there. I thought the whole country was a free- speech area.' After refusing several times to go to the area, he was handcuffed and arrested on a charge of disorderly conduct. When his sister argued against the arrest, she was cuffed and hauled off as well. The two spent the president's visit in a firehouse that was serving as Secret Service headquarters for the event. The Neels' experience is not unique. On Sept. 23, the American Civil Liberties Union filed a lawsuit in a federal court in Philadelphia against the Secret Service, alleging that the agency, a unit of the new Homeland Security Department charged with protecting the president and other key officials, instituted a policy in the months even before the Sept. 11 terrorist attacks of instructing local police to cordon off protesters from the president and Vice-President Dick Cheney. The ACLU has identified 17 separate incidents in which protesters were segregated or removed during presidential or vice-presidential events. I wouldn't be surprised if this is just the tip of the iceberg, says Pittsburgh ACLU legal director Witold Walczak. We don't have the resources to follow Bush and Cheney everywhere they go. The suit comes at a time of mounting charges by civil libertarians on both left and right that the Bush administration and Attorney-General John Ashcroft's justice department are trampling on civil liberties. Nor is the Secret Service's carefully worded denial of responsibility as definitive as it might appear. The establishment of viewing areas is indeed a local responsibility, but local officials say the Secret Service has in some cases all but ordered them to pen in protesters. As a number cruncher, I have a theory that the so called Elite and some of the worlds leaders of today know the probable date for the Battle of Armageddon and knowing this coming date will cause them to act accordingly. And I strongly suggest that the Battle of Armageddon will take place on December 22nd 2012, the same day as the end of the Maya Age of the Jaguar. The last the date when there was much spiritual activity seen over Israel was 1,933 years ago when the angels saw the destruction of the Temple of God in Jerusalem by Emperors Vespasian son Titus, who burnt the Temple during the weekend of August 4th and 5th August AD70. And this was after months of attacking Jerusalem and killing hundreds of thousands of Jews. The Battle of Armageddon will last only on day, even though the worlds largest armies will gather over 5,000,000 military personnel and the greatest amount of military weaponry and equipment ever recorded in the history of the world, so to war against the army of Israel and the Lord God of hosts. And just like the witnesses who wrote about that terrible week-end in AD70 there will be angel air battles seen in the sky above Jerusalem once again. And this event will be a one off, a light fantastic show of fire and thunder and explosions, mayhem and of course the destruction of the all the attacking armies, so to killing most in this great army. Even though two different federal courts have conducted hearings and issued rulings, there has been no public record of any action. No documents are available. No files. No lawyer is allowed to speak about it. Period. Yet this seemingly phantom case does exist - and is now headed to the US Supreme Court in what could produce a significant test of a question as old as the Star Chamber, abolished in 17th-century England: How far should a policy of total secrecy extend into a system of justice? Secrecy has been a key Bush administration weapon in the war on terrorism. Attorney General John Ashcroft warns that mere tidbits of information that seem innocuous about the massive Sept. 11 investigation could help Al Qaeda carry out new attacks. Yet this highly unusual petition to the high court arising from a Miami case brings into sharp focus the tension between America's long tradition of open courts and the need for security in times of national peril. At issue is whether certain cases may be conducted entirely behind closed doors under a secret arrangement among prosecutors, judges, and docket clerks. While secret trial tactics have reportedly been used by federal prosecutors to shield cooperating drug dealers, it's unclear whether the high court has ever directly confronted the issue. But that may change if they take up MKB v. Warden (No. 03-6747). What's known about the case This is among the first of the post-Sept. 11 terrorism cases to wend its way to the nation's highest tribunal. There was no public record of its existence, however, until the appeal was filed with the clerk of the US Supreme Court. A federal judge and a three-judge federal appeals-court panel have conducted hearings and issued rulings. Yet lawyers and court personnel have been ordered to remain silent. "The entire dockets for this case and appeal, every entry on them, are maintained privately, under seal, unavailable to the public," says a partially censored 27-page petition asking the high court to hear the case. "In the court of appeals, not just the filed documents and docket sheet are sealed from public view, but also hidden is the essential fact that a legal proceeding exists." Despite the heavy secrecy, a brief docketing error led to a newspaper report identifying MKB by name in March. The report said MKB is an Algerian waiter in south Florida who was detained by immigration authorities and questioned by the FBI. MKB's legal status remains unclear, but it appears unlikely from court documents that he is connected in any way to terrorism. He has been free since March 2002 on a $10,000 bond. The case is significant because it could force a close examination of secret tactics that are apparently becoming increasingly common under Attorney General Ashcroft. In September 2001, he ordered that all deportation hearings with links to the Sept. 11 investigation be conducted secretly. In addition, the Justice Department has acknowledged that at least nine criminal cases related to the Sept. 11 investigation were being cloaked in total secrecy. MKB v. Warden is the first indication that the Justice Department is extending its total secrecy policy to proceedings in federal courts dealing with habeas corpus - that is, an individual's right to force the government to justify his or her detention. The case offers the Supreme Court an opportunity for the first time to spell out whether such secret judicial proceedings violate constitutional protections.
