Warrant of Agent Davy Aguilera

There would never have been a raid on Mt. Carmel if Special Agent Davy
Aguilera had lived up to the oath he took before joining the ATF.  In that
oath, Aguilera swore that he would protect the Constitution of the United
States from all enemies, foreign *and domestic*.  Unfortunately, he must
have forgotten that part when he personally wrote the 15-page search warrant
that was to have been served to David Koresh on February 28.  This warrant,
composed by a federal agent given the responsibility, or honor, of
protecting citizens of the United States against threats to our happiness
and freedoms, reads like a grocery store tabloid or a copy of the Waco
Tribune-Herald!

Unlike the Tribune-Herald, Aguilera does go into more detail concerning the
alleged gun violations, which is the only thing concerning Mt. Carmel that
the ATF had any jurisdiction over.  Just the same, the ATF warrant is filled
with the testimony of Mark Breault and his friends.  Paragraph after
paragraph explains how David Koresh was running a military compound.  All of
these allegations originate and are supported (both) by Marc Breault, as he
claimed that he not only witnessed these activities, but took part in them!
Aguilera never bothered to question Marc about his sincerity, so it seems,
since the fact that Marc was blind never materialized.  It would have been
very hard for Aguilera to justify Marc's allegations if he had been aware of
this handicap, since Marc admitted that he took part in these military
drills, including target practice and armed guard duty.

Excerpt from the original warrant written by Davy Aguilera:

"On January 8, 1993, I interviewed Marc Breault in Los Angeles, California.
He is an American citizen who lives in Australia with his wife Elizabeth.
He was once a member of the "Branch Davidian" in Waco, Texas.  He lived at
the Mount Carmel Center from early 1988 until September 1989.  While there
he participated in physical training and firearm shooting exercises
conducted by Howell.  He stood guard armed with a loaded weapon.  Guard duty
was maintained."

Other, more significant, parts of the warrant were equally as ridiculous.
Aguilera explained in detail that magazines such as the Shotgun News were
known to have been present at Mt. Carmel.  This particular magazine has a
subscription list of over 150,000 and can be purchased in most newsstands,
but Aguilera refers to it as a "clandestine magazine!"  Virtually all gun
dealers subscribe to this publication because of its extensive advertising.
Since Paul Fatta, Mike Schroeder and others living at Mt. Carmel made money
buying and selling guns and gun accessories at gun shows, it is only natural
that they would have copies of Shotgun News around.

Aguilera got to the meat of the matter when he tried to show that David
Koresh had possession of machine guns.  Although he lists huge quantities of
gun parts that David and others had ordered, very few *could* be anything
close to parts intended to convert a semi-automatic rifle to a machine gun.
The EZ kits that Aguilera mentioned were in fact E2 kits, purchased from
Nessard Gun Parts and do not constitute an illegal weapon of any kind.
Aguilera filled the huge gaps in his accumulated circumstantial evidence
with reports of gunfire made by neighbors, child abuse, adultery and other
less volatile tidbits of senseless rhetoric that had all been investigated
and dismissed long before he wrote the warrant.

It is difficult to understand, and exceptionally scary, that the warrant
written by Davy Aguilera did, all by itself, justify and ultimately lead
directly to the assault on Mt. Carmel by nearly 100 armed and specially
trained soldiers.  It is a fact that all a government agency needs is a
bunch of jealous old friends willing to gossip and a few unsubstantiated
rumors of possible violations to orchestrate a deadly raid against an
American home?  This is precisely what has happened!  It is all the more
disturbing to know that Magistrate Green in Waco signed off the lives of
those in Mt. Carmel Center based on Aguilera's gossip column of a "warrant!"
Disturbing or not, this is what happened, and we are, or so it seems, quite
powerless to do anything about it.

(If anyone needs the background on Marc Breault, let me know and I'll retype
that part of the book, too. I don't have a scanner.)

Thank you Jean Staffen for making the Waco warrant available.

THIS is a warrant from a US Government Agency ?  agent Aguilera is acting on
behalf of the US Goverment with unsupported gossip.?  God help us!

Looks as if ATF wanted to make a big show at budget time to influence
Congressand Congress couldnt figure that back in 1993?

Lets see if the media picks up on this and digs out the original warrant with
Judge Greens explanation..
