I am not sure I can follow what the object of this report is,
and I certainly do not see why a serious priority is justified. What
exactly is the potential for litigation here in policy? The bug
number referenced offers no further explanations

The first patch that I submitted would fail after the base tarball was
updated because /dev/ptmx would exist. The attached patch makes it
create it only when necessary.
