Well, I do not buy the argument that everything in /etc/ should be a conffile, and /etc/init.d/rc should defnitely not be a conffile. See #132542 for a early BTS report about the same issue. What that is said, my long term plan is to move it to /lib/init/rc, but I have never seen it as important enough to give it priority.
