The part of policy you quoted says the copyright file should be in debian/copyright, not must. Sorry, but I don't know the exact history of the policy. The actual version says in §1.1: "Non-conformance with guidelines denoted by should (or recommended) will generally be considered a bug" So we can discuss about the severity of the bug, but it still remains a bug.
