This happens also on 10.04. The workaround is to install gedit-plugins and enable the session saver plugin. With this plugin, language and auto spell check settings will be retained after reopening for the current document at least. -- Remember autocheck spelling setting

As stated this bug doesn't address the issue I found. This one only adresses if autospellcheck is remembered. Mine addressed that the wrong English dictionary was used and as well as requesting a spellcheck the user had to specifically select the dictionary to use for every gedit sessions.
