If you are using the XSLT 1 stylesheets, then placing an empty element where you want a TOC, and setting the 'process.empty.source.toc' stylesheet param to 1 will generate a TOC for that element.  It applies to hierarchy elements like chapter and section, but not arbitrary elements.

Actually, there's a param for that.  If you insert an empty element in your content, and set this param: process.empty.toc.element=1 and set generate.toc to blank (to turn off the default toc), then the stylesheet will generate a toc where that element is located.  Apparently this param
