Public Folder Send As

I suspect a Murphy rather than a real bug, but I'm unable to send as a public folder (nor a Distribution List). The error in outlook states: You do not have the permission to send the message on behalf of the user. I do have the send as box ticked. I have checked and double checked the rights,

Any Idea why this is happening? I am sending on behalf of a public folder and sometimes it works, and sometimes it doesn't. The sometimes is doesn't it gives me the you don't have permission error. I am the owner of the folder and I have given myseld send as permission on the folder.
