Is that the attitude of the recerted teachers or even of the rajahs 
themselves? Sad, if so. OTOH, my impression is that MOST participants 
have some clue about how silly it looks to most people.

I think you are right.The TMO is more and more like a Religion mixed 
with Non-Democratic Ideas. I think it is hard for a true Muslim and 
other Religions to accept that. And also people who want Democracy. 
It seems that TM as an easy, effortless technique to release stress 
and strain, is over-shadowed by all this weird things. When I do the 
Puja as a part of the Initiation, I explain that this belong to an 
old Tradition, because TM belongs to an old Vedic Tradition. 
Everybody accept it. What people is reacting on, is the Rajas, the 
Focus on money, among lot of other things.

I'm not sure I understand the question.  Most people
who learn TM pay their money, get their instruction,
and go off and practice on their own without having
any further contact with the TMO, except perhaps for
an occasional checking session.  Surely you would agree
that this is a fact, not a subjective impression?

Wherever the TMO may be on the cult scale, it exists
to teach people to meditate, not to recruit them into
the organization, unlike, say, the Moonies.  You have
to make a decision to become more involved; and if,
like your student, you're wary of being drawn in to
start with, it's highly unlikely that you will be.

Seems to me the number of teachers who have become
independent, or would like to be able to teach
without having to go along with all the nutty stuff,
is evidence of what I'm pointing out.

 Personally, I'm rooting for Mike.

I think it's a moot point. As Irmeli and others have
pointed out, all that the TM lawyers can do *is*
threaten. They're terrified to have this actually
come to court, because they could *lose*, and thus
lose their precious monopoly.

Interestingly, I used to know Mike Scozzari. I gave
my first TM lectures after teacher training down in
Florida, and he was already there and already enthus-
iastic. Although I haven't seen him since, I'd be
willing to bet that (another value judgement here)
he's simply more committed to the original idea of 
TM than to the reality of TM as practiced and taught
by the modern TM organization. The idea of TM was
to make a simple, easily-learned technique of 
meditation available to anyone who was interested,
at a reasonable cost. The reality of TM is that
it's the new gateway drug to involvement in a 
cult, and is priced in the same neighborhood as
cocaine. I think Mike's approach is a good one;
you can tell *how* good by the extent to which
the new drug pushers of the TMO react to it and
the extent to which they attempt to demonize some-
one who still believes in ideals that they have
sadly forgotten.

The side of a dedicated TM teacher who wishes to
continue honoring his original commitment to teach
a potentially valuable technique of meditation at
a reasonable price and who wishes that the organ-
ization that represents that technique still felt
the same.

They *really* wouldn't want me as a witness in 
such a case. I spent several years at the TM National
Center in L.A., in a position where I was privy to
all sorts of illegal moneylaundering and coercive
activities with regard to TM teachers.

Me, I don't teach TM any more and never will again,
but I do feel for someone who wishes to do that,
honoring his original commitment to the TMO and
wishing that they had a similar sense of honor to
those they had commissioned in the past as teachers.

I think it's a hybrid American/French term. The 'pom'
seems to refer to 'pom pom,' as in the things that
cheerleaders wave around as they dance. The 'pous' is 
a French slang term for what the spectators are really

I have mixed thoughts about the independent teacher in florida.   I
know from experience how challenging it is to run a local center, it
requires tons of dedication.  This guy has been doing that for decades
apparently and his heart is invested.  The new certifiables don't have
that emotional investment in the community and may indeed be long gone
from the area as soon as the NEXT BIG THING is announced in 4 months.  

I don't know how unrealistic he is, as mdg discussed, as he has a real
job and does 7 steps in his spare time, teaching whoever happens to
show up.  What's he supposed to do - join up with the certifiables and
make a presentation to the mayor on bulldozing downtown Miami in order
to bring about world peace?

OTOH I feel MMY has a right to destroy his mov't or at least the TM
part of it if he wants, and a copyright is a copyright

very loosest sense of the word? 

 It's all very sad.

The profile of the TMO is business and cult. That is what 
ordinary people seemore and more, when they hear the prices and 
learn what the TMO stands for.
An Indian Muslim came to me and learned Transcendental Meditation 
some weeks ago. (I am an Independent TM-Teacher). He had first 
checked out the TMO - and when he came to me, he said: I do not 
want to be a part of a cult with Rajas and stuff. I do not want to 
be a part of an organisation who has over-prized their courses. I 
just want to learn Transcendental Meditation.

True, provided he was solely responsible for its development. This is 
the case, provided you remove from history the countless individuals 
who contributed time, money and professional standing. Copyrights 
provide a legal framework. A more principled offering would spring

But that's not what the court case would be about. All of that is 
immaterial to someone using a registered trademark without 
permission. More than likely, a good TMO lawyer could get any and all 
witnesses/testimony/facts pertaining to these points excluded

 They *really* wouldn't want me as a witness in 
 such a case. I spent several years at the TM National
 Center in L.A., in a position where I was privy to
 all sorts of illegal moneylaundering and coercive
 activities with regard to TM teachers.

And you probably wouldn't be called because any such testimony is 
irrelevant to the question: does the TMO have the right to say who 
can and cannot use its registered trademarks?

 
 Me, I don't teach TM any more and never will again,
 but I do feel for someone who wishes to do that,
 honoring his original commitment to the TMO and
 wishing that they had a similar sense of honor to
 those they had commissioned in the past as teachers.


Again, irrelevant to any court case the TMO would bring.

TMO will be too terrified to allow the issue to come
to court. This is all bluster and threats.

But if it did, I don't really have the money to be

No, I did not. I do not argue about the TMO with people. The only

responsibility. People see what they see and make their own 
thoughts.

Actually I've seen the Rajas and Stuff stop interested folks from
learning TM. People who were once enthusiastic about learning spend a
couple of hours surfing the web and then never mention TM again. I'd
bet that happens far more often than we know.

I'm sorry, you're not allowed to change the reasons for a lawsuit. 
You must be the plaintiff to do that. What damage is being done to 
the plaintiffs by the TMO attempts to enforce their trademark rights?

I actually think that the TMO doesn't really want to teach anyone in
the West the TM Technique. The impossible contrast between the what
they say and what they do seems to generate funds in an almost magical
way. Obscure the reality, milk the true believers, prosper in real
estate. It's unbelievable! We're so Deeevine, Our Actions are Soo
Subtle. You Dunderheads just don't UnderSTAND! Oh, and by the way we
do accept MasterCard and Visa (to promote World Peace, of course.)

   have been operating as such for the last 33 years. I have thousands
   of my students and clients in the South Florida area. I am well known
   to TM teachers in South Florida and to fellow TM teachers both Nation-
   ally and abroad. My advertisements have been placed in the Palm beach
   media since 1990.
  
   You may forward this letter to Mr Goldstein'. Kindly tell him that his
   assertions that I am in infringement of the service marks in question
   does not necessarily make it so. If Mr Goldstein feels that there has
   been some infringement,  his remedy surely lies in bringing the matter
   before a court of law -- not in complaining to you. If such an action
   were brought by him I along with many other TM teachers with whom I am
   in contact would be strenuously and vigorously contesting his allega-
   tions in a class action suit.  As a self styled copyright attorney Mr.
   Goldstein ought to know that copyright matters are often complex and
   can only be decided by a court oflaw after carefully hearing both
   sides.
  
   Mr Goldstein should be told that a magazine such as yourself cannot
   be expected to get involved in complaints of this nature and that you
   have no intention of getting involved simply on the basis of his alle-
   gations. They are at best his point of view on the matter. If and when
   the matter has been decided by a court of law in his client's favor
   then and only then should he approach your magazine in the manner that
   he has.  Until then, you can take no action on his unsubstantiated
   allegations. That is the end of the matter so far as your magazine is
   concerned.
  
   Indeed,  this is the only position you can fairly take in the circum-
   stances.  Were you to take action on Mr Goldstein's allegations you
   would be doing a great injustice to legitimate clients like myself who
   have been doing business with you for a considerable period of time.

Dear Fairfield Lifers,

There's a lot of misinformation being bandied about in the discussion
of this situation here on FFLife.
I live a mile from this teacher, Mike Scozzari, in Boca Raton Florida.
I've met him and talked with him.
I'm on his e-mail list for announcements about his TM activities.
I see his ads in the local new age magazine that I pick up when I shop
at Whole Foods.
I've also met the local recertified TM teachers and heard them discuss
their interactions with Mike since they arrived here.
Without making any judgments about either side, here are the facts
and impressions I've gathered locally:

People tell me that Mike Scozzari was one of the founding TM teachers
decades ago in the southeast Florida area (Miami).  He did his teacher
training course in 1972, and did a lot of TM teaching here in the good
old days.  Apparently he became a Governor (took the TM-Sidhis program)
somewhere along the line.  When Maharishi's focus changed away from ini-
tiations, and the local center(s) here closed up, Mike continued to try
and teach TM and had trouble adjusting to all the new stuff.  When the
price of TM increased in the 90s, he balked, and set his own pricing.

When I first moved here a couple of years ago from Fairfield, I saw his
TM ad.  So I went to his advertised location for the introductory lecture,
to introduce myself to him, to check him out, and to see what kind of local
meditating community there might be.  He told me that he'd been renting
this conference room in a local Kinko's on Federal Hwy. in Boca Raton
every week for quite a while.  He'd advertise an intro lecture, and show
up - but he admitted to me that hardly anyone had ever attended.  The
night I came to meet him, it was just he and I, and we talked and got
to know each other for over an hour.

He told me that he's married, and he's a traveling sporting goods sales-
man by day.  He said that he had some interest from a couple of companies
to do an in-house TM presentation, and maybe a course, for them.  I men-
tioned that I'd helped design the old TM business program (AFSCI), and
taught it in Chicago in some big companies, and I'd be happy to be of ser-
vice (even go with him to give the presentations without any compensation).

 There's a lot of misinformation being bandied about in the discussion
 of this situation here on FFLife.
 I live a mile from this teacher, Mike Scozzari, in Boca Raton Florida.
 I've met him and talked with him.
 I'm on his e-mail list for announcements about his TM activities.
 I see his ads in the local new age magazine that I pick up when I shop
 at Whole Foods.
 I've also met the local recertified TM teachers and heard them discuss
 their interactions with Mike since they arrived here.
 Without making any judgments about either side, here are the facts
 and impressions I've gathered locally:

 People tell me that Mike Scozzari was one of the founding TM teachers
 decades ago in the southeast Florida area (Miami).  He did his teacher
 training course in 1972, and did a lot of TM teaching here in the  
 good
 old days.  Apparently he became a Governor (took the TM-Sidhis  
 program)
 somewhere along the line.  When Maharishi's focus changed away from  
 ini-
 tiations, and the local center(s) here closed up, Mike continued to  
 try
 and teach TM and had trouble adjusting to all the new stuff.  When the
 price of TM increased in the 90s, he balked, and set his own pricing.

 When I first moved here a couple of years ago from Fairfield, I saw  
 his
 TM ad.  So I went to his advertised location for the introductory  
 lecture,
 to introduce myself to him, to check him out, and to see what kind  
 of local
 meditating community there might be.  He told me that he'd been  
 renting
 this conference room in a local Kinko's on Federal Hwy. in Boca Raton
 every week for quite a while.  He'd advertise an intro lecture, and  
 show
 up - but he admitted to me that hardly anyone had ever attended.  The
 night I came to meet him, it was just he and I, and we talked and got
 to know each other for over an hour.

 He told me that he's married, and he's a traveling sporting goods  
 sales-
 man by day.  He said that he had some interest from a couple of  
 companies
 to do an in-house TM presentation, and maybe a course, for them.  I

 tioned that I'd helped design the old TM business program (AFSCI), and

About a year ago I had the opportunity to speak to Mike S. I admired
his tenacity and the fact that he was teaching regularly. Four people
a month is probably more than the re'certs are doing. I guess it all
depends on whether you think the TMO should honor it's agreements with
teachers or not. And whether the TM Organiztions should actually teach
the TM technique or just raise money.

I hope this gives FFLife readers some perspective on the local 
   situation
here in south Florida.  It's caused much more heat on the 
FFLife

it has here locally!  Locally, other than his ads, Mike's TM

The few times that my schedule has allowed me to go to a TM

I would not say he approved, but rather that he was acknowledging 
someone was benefiting from learning meditation. I don't think that 
has ANYTHING to do with whether or not someone is pocketing all the 
money they charge, anyway. Part of the long-term agreement between 
the meditator and the TMO is that all TM teachers will check 
meditation of anyone taught by any other TM teacher. Without quality 
control, and a network of mutual obligations as defined by monetary 
exchange, who can say who learned what from whom? The TM org as the 
central coordinating body for keeping the teaching pure requires at 
least SOME money to keep its doors open. Teachers that go outsideof 
this may be benefiting a few in the short run, but what about the 
long run?

The thing is, it will never come to court because the
TM movement is terrified that it would *lose* in a 
court case.  There have been *dozens* of legal precedents
of companies trying to 'recertify' its sales representatives
to get more money from them without actually giveing them
any new training or products to sell, and every one of them
tends to lose in court, for obvious reasons.  copyright
law is one thing; an obvious attempt to extort money from
your own employees is another.  Courts and judges are human,
and can see past an obvious greed-scam.

Especially if a judge sees that the rogue teacher has
been working in good faith for the organization for
many years and that there truly is no difference
between a recertified and a non-recertified teacher.

But TM teachers aren't salesmen in that sense. They represent a 
copyrighted trademark. And the TMO isn't trying to get more money 
from the TM teachers, but from their customers, since the FEE has 
been jacked up, not just the required payment from the sales side. 
The TMO certainly has the right to set the PRICE for the item 
for sale, don't you agree? And as long as the TM teacher is 
representing themselves as a TM teacher, they're cashing in on the 
advertising and reputation of the TMO, which has spent a LOT of money 
and time and effort to create the market for TM.

No, the TMO may not have pursued people with a vengance before now, 
but unless the judge rules that they didn't put enough effort into 
protecting the trademark previously, the TMO stands to lose MILLIONS 
in the next few years and they WILL pursue people now.

Mark my words, etc.

 Especially if a judge sees that the rogue teacher has
 been working in good faith for the organization for
 many years and that there truly is no difference
 between a recertified and a non-recertified teacher.
 But then again, you do have trademark law which does
 lean in the direction of the TMO.
 


It boils down to this (plus whatever other laws come into play 
because a good lawyer can find precedent for BOTH sides of any legal 
action): does the TMO have the right to set the pricing for the use 
of their trademark?

Without lots of case law to say different, the TMO will obviously win 
this one, should the chose to pursue it.

Stop kidding yourself. The 'recertification' was just
so that the TMO could charge existing TM teachers (that
is, suckers) some extra money TO be 'recertified.' That
and get them to sign up-to-date legal agreements that
would be more binding.

In the process they turned off most of their most ardent
supporters among the TM teachers who were still teaching.
It's ALL about money.

And they will NOT pursue any of these things beyond the
point of making vague threats. They simply cannot afford
the possibility of a real court case, because too many
things about the TMO's cultlike nature would come out
in such a case, and there is a good chance they'd lose.

The TM teachers ARE salesmen, BTW.  Who do you think
does the actual work of putting up posters, giving 
lectures, and teaching new people?  It certainly isn't
the movement; they're doing everything in their power
to HINDER more people from starting.  The administration
of the TM movement couldn't sell toilet paper to a man
dying of diarrhea.

It will be interesting to see what happens with this magazine 
advertising thing. My guess is that the TMO will have shown good 
faith in protecting their trademark and the magazine will stop 
advertising for the uncertified teacher at least using the words TM 
and Transcendental Meditation, if they haven't already. As far as I 
know, the owner of a trademark can arbitrarily yank permission for 
someone to use that trademark any time they want.Certainly, the TMO has 
given plenty of warning concerning recertification, rajah craziness, 
etc.

But that's all trivial stuff...

What many seem to have missed is just how stunning this new development 
concerning universal student loans for qualified prospective TMers is. 
Regardless of what you think of TM itself, the TMO, the pricing scheme, 
the treatment of uncertified teachers, the rajahs, etc., there's no 
denying that the ability for anyone with good credit to be able to 
obtain a loan from Citicorp to learn TM makes TM completely mainstream.

It also explains why MMY has been saying for some time now that if you 
build it [the peace palaces], they will come: negotiations for this 
student loan thing must have been going on for quite a while. The old 
man is crazy like a fox, as the saying goes...

I believe Mike Scozarri is recertified. But the course made him realize just
how bizarre and cultish the whole thing has become, so he bolted.

 TM *was* mainstream years ago, it hasn't been for years other than  
 through going to extraordinary lengths by their global marketing  
 apparatus to keep it in the public eye.
 
 The mainstream now is SSRS and various brands of Buddhist 
meditation.  
 Vipassana courses--which are 10 day long courses--are filling up  
 months in advance and have huge waiting lists. And they don't even  
 advertise or send B-celebs around to market for them.


The TMO at one point was teaching 35,000 people per month inthe USA. 
MMY trained thousands of TM teachers over the years. If the situation 
were equivalent, you'd have a backlog of literally MILLIONS of people 
wanting to learn Vipassana all at once. And people only value what 
they have to pay for - the more the better. Any meditation teacher in 
this day and age who doesn't get that is just engaging in spiritual 
masterbation.

DId he sign any new paperwork? If he did, like as not, he has NO 
legal leg to stand on. If you agree to play the game their way and 
then decide you don't like their way, you can always go start your 
own game, but you CANNOT claim that you're playing the game their way 
while condemning them for playing the game their way.

He who owns the trademark gets to make the rules, so unless his 
lawyers can show some illegal actions on the TMO's part, he can't do 
a thing. Even if he DOES show illegal actions, all he can ask for is 
monetary compensation. He STILL can't use the trademark without the 
owner's permission, no matter how strange the owners get.

FWIW a dear friend has been teaching TM out of synch with the TM org
for about a decade now. Early on the same TM legal dept. sent him many
very scary *cease and desist* letters which, though they scared my
friend, did not stop him. Nothing came of it and he has been quietly
and steadily teaching TM all this time, probably averages ten
intiations or so per month (charges $495).

does he send any money tothe national organization, I wonder? If he's 
continuing to work under an old contract, he may have some 
justification. The guy advertising inthe magazine apparently went 
through the recert process, which I would THINK involved signing all-
new, all-improved sign-your-firstborn-away contracts.

Regardless, if he's not advertising it as TM in paid-for advertising, 
he's probably more safe than the recerted guy who is.

Then it will go back to any prior contracts, and who actually owns 
the trademark. My guess is that he won't be able to advertise atthe 
least, and the TMO may have to buy him out, but if the court actually 
orders him to accept payment for his loss of use of the trademark, 
he's SHOL.

And, unless the TMO loses ownership of the trademark, I can't imagine 
any judge ruling that the owner of the trademark can't control who 
uses it in a commercial setting.

Note that I'm not a lawyer, but this is the most obvious common sense 
way for these things to be dealt with so unless the law gets REALLY 
convoluted, I suspect that that is what will happen.
