It is totally on right now. This is the moment of truth for the
Millennium. I am calling my friend who is an attorney to talk about
the situation, both internally and in connection with the current
service of papers. Perhaps we could settle them down, but I do
believe that they have crossed the Rubican. Going to court mean that
they want us out.
There is an intriguing possibility. The building is not technically
owned by La Mama, but instead by 66-68 E 4th Street entity, which is a
nonprofit. Two of the founding board members were Howard Guttenplan
and Jerry Tartaglia. Howard signed the charter as in incorporator.
It was mentioned that they would change the board at the first meeting
so it is possible that everyone that wasn't with La Mama was removed
at the first meeting. However, it is possible and I would say likely
that Howard is still on that board.
This entity was just created and left alone. It never filed anything
after incorporation, never did notices or 990s to the IRS. It lost
it's exempt status in 2010. It is possible that the Millennium is a
member of the entity. It could sue to remove the other board members
and basically take over the building. Have to check with an attorney
on that one, but it could be a possibility.
