The answer is cvsup4.uk.FreeBSD.org does not have 4.9
release code. Just switch to another cvs server that
host 4.9 release should be OK.

What i always do in case of troubles,
mv /usr/src /usr/src.orig
cvsup -g -L 2 $supfile
so i always have a valid backup in case things go totally wrong :)
