if nothing has changed, the file stayed the same.

You can make a simple test. Delete or rename it and start csup again.

If it reappears, it has to be the old file.

I downloaded the sources of freebsd 6.3 via
cvsup.  
  
Where the new kernel file is copied? I've checked
into /usr/src/sys/i386/conf/ and the GENERIC file
has the old date.
