Just in: After four months of deliberating, Judge Robert Patterson has 
ruled that the Sarah and the castle of witchcraft and wizardry game 
infringes J.K. Rowling’s copyright in the Harry Potter series.


According to the AP, Judge Patterson granted an injunction, ruling that 
Rowling had proven that PCS Game’s “Sarah and the castle of witchcraft and 
wizardry” would cause her irreparable harm as a writer.


The suit, filed late last year against PCS Games, an independent game 
developing company in Michigan, alleged that plans by Michigan-based game 
developer PCS Games to sell a game, Sarah and the castle of witchcraft and 
wizardry, who's Web site that serves as a rather daunting compendium of 
all games for the blind, violated Warner and Rowling’s copyright and takes 
away the future market for a similar game that Rowling and Electronic Arts 
plans to develop.


Here’s the opinion.

Judge Patterson ruled in Rowling’s favor because the “Sarah game 
appropriates too much of Rowling’s creative work for its purposes.” He 
also wrote that, “While the Sarah game, in its current state, is not a 
fair use of the Harry Potter works, games that share the Sarah game’s 
purpose of aiding blind game players of being able to play a Harry Potter 
game generally should be encouraged rather than stifled.”


Ethan Horwitz, an IP lawyer at King  Spalding, told the Law Blog: “What 
Judge Patterson is saying is that when you look at fair use, one of the 
dominant issues is, are you providing commentary or taking the value of 
the work and selling it as your own? He decided that the value of the work 
was being taken, that [Rowling] had the ability to develop the kind of 
game that PCS Games was putting out, and that she’d indicated an intent to 
do so.”

  Converted constants to enumerated constants.

  You can once again use the escape key on the keyboard to exit the game.
  When using a joystick or game pad button 1 can now be used to pick up 
  items or open doors when weapons are holstered. Draw weapon to fire.
  The spacebar now picks up items and opens doors when weapons are 
  holstered, and fires the current weapon when weapons are drawn.
  Fixed the problem with jump up not always grabbing the rope.
  It is no longer possible to draw a weapon while hanging from a rope.
  Fixed bug when player strength gets stuck at 83%.
  Fixed bug where Angela's comments get interrupted by status messages.
  Menu music is now lowered when in the sound descriptions menu.
  Updated load game menu.
  Updated save game menu.
  You can now load and save games while in standard game mode.

[Audyssey] Moderator's note: new hosting not working out

Hello everyone. I am sorry to report that the hosting I just switched 
the audyssey server is not going to pan out. It turns out there was some 
small writing in the terms of service which state that any time there 
are more than 50 messages per day for the entire account, there will be 
additional charges for extra bandwidth and mail server usage. So 
unfortunately I'm back to hunting for a new hosting company. The cool 
thing is  that I'm still within my grace period so can back out of this 
hosting company as long as I do so within the next 5 days.


I don't want to go back to the one I had before because I'm limited in 
the number of mailing lists I can have and I need at least 3, and most 
of the other web hosting providers won't allow a list of this size with 
this much traffic. Anyone rememberer when we switched to Bluehost for a 
bit? Messages were limited to 250 per hour, this meant that the list got 
quickly bogged down.


Just wanted to update everyone on this and I'll post later when and if I 
have an update on this.

Hi, I know this is way late, but I wanted to set the record straight.

Raul Gallegos is the name, and liamerven.com/games is the name of the 
game. Or rather the game site. He's been kind enough to host it for me, 
and I do plan on putting them back on asmodean, but right now I have no 
personal space at home to do it in, and not only that, my current isp 
does not allow the right ports to get them from unless I do ftp which I 
don't want to do.

[Audyssey] legends of zork is live

Hello everyone. This morning, I played my first cession of Legends of Zork. I 
created my first character, Eldrex. He's a recently fired magic sword salesman. 
I've managed to advance two levels and survive my first day's explorations of 
the dark forest near the white house. The game is completely playable for us 
blind Zork fans. However, when it comes to more minor points like choosing your 
character avatar, there are no alt tags on the choices. I have no idea whether 
what I perceive as a buff, rough and ready male adventurer is depicted visually 
as a wafer-thin fashion model. The map is certainly functional enough for us as 
the locations near enough to travel to are properly labelled. Exploration 
doesn't rely on seeing anything. You just click on the explore the dark 
forest or a similar link in order to search an area and have encounters. It's 
a lot like Legend of the Green Dragon in that regard. I hope those who are 
interested will try out this new browser based online game and take the time to 
send feedback to the developers. Happy adventures, everyone.

back to hunting for a new hosting company. The cool thing is  that I'm 
still within my grace period so can back out of this hosting company as 
long as I do so within the next 5 days.


I don't want to go back to the one I had before because I'm limited in the 
number of mailing lists I can have and I need at least 3, and most of the 
other web hosting providers won't allow a list of this size with this much 
traffic. Anyone rememberer when we switched to Bluehost for a bit? 
Messages were limited to 250 per hour, this meant that the list got 
quickly bogged down.


Just wanted to update everyone on this and I'll post later when and if I 
have an update on this.

[Audyssey] Rail racer - looking for a way to avoid losing money whilst configuring a control pad

Hi all,

I purchased Rail Racer a week ago, finally getting a chance to sit
down with it now.  So, I've won a few races with the keyboard, won a
few with the mouse, but seeing as I'm a console boy at heart and I
found a cheapo USB controller I never knew I had earlier, I thought
I'd have a crack at using that.  I would stick with the mouse, but I
was racing using one of those laptop trackpad style setups and I'm not
sure it actually gave me any more control.

So, my question is... is there a way to quit a race without forfitting
and losing the entry fee?  Reason I ask is, this pad doesn't seem to
be playing ball particularly well yet, and I'm losing stupid amounts
of money here by reconfiguring testing and forfitting upon failure
each time.

Stuff like this is why I feel that fine print in contracts should be 
illegal.  It should all be in the same sized print so that a fast one cannot 
be pulled on people.  If it takes more paper to be ethical, so be it.  I'm 
not saying that the provider is dishonest, but a lot of unethical business 
practices do exist, and this is one of them.  JMO.

Hi Scott, If you race online, you don't need to pay entry fee. It's a way to 
test your configurations without losing any money.

Well, I've had a look at the game, but thus far I'm slightly disappointed 
with the lack of description in it, it's just you encountered an X and 
rolled an X nowhere near the richness of the zork games i've played.


I'll carry on with it for a bit though, just in case this is an initial 
problem,  afterall there are lots of areas I stil can't get to.

Yeah, I'm a bit disappointed myself, its kind of like dragon tavern without 
the originality. The sub locations don't even have descriptions. Pretty much 
looks like a dragon tavern ripoff, battle system, skills, even the perks 
aside from naming are the same. Seems rather hardcore number oriented, which 
isn't what I was expecting, and the strategy element is weird. I'll probably 
play it for a while, but it'll get old just like every other number cruncher 
out there.

I've got half a mind to actually send them a report, sinse it's obviously 
stil in developement,  and they've got such a rich lot of backstory to 
make locations, characters and all the rest out of. I'll probably check it

Yeah, I'm a bit disappointed myself, its kind of like dragon tavern 
without the originality. The sub locations don't even have descriptions. 
Pretty much looks like a dragon tavern ripoff, battle system, skills, even 
the perks aside from naming are the same. Seems rather hardcore number 
oriented, which isn't what I was expecting, and the strategy element is 
weird. I'll probably play it for a while, but it'll get old just like 
every other number cruncher out there.

Hello everyone. This morning, I played my first cession of Legends of 
Zork. I created my first character, Eldrex. He's a recently fired magic 
sword salesman. I've managed to advance two levels and survive my first 
day's explorations of the dark forest near the white house. The game is 
completely playable for us blind Zork fans. However, when it comes to 
more minor points like choosing your character avatar, there are no alt 
tags on the choices. I have no idea whether what I perceive as a buff, 
rough and ready male adventurer is depicted visually as a wafer-thin 
fashion model. The map is certainly functional enough for us as the 
locations near enough to travel to are properly labelled. Exploration 
doesn't rely on seeing anything. You just click on the explore the dark 
forest or a similar link in order to search an area and have 
encounters. It's a lot like Legend of the Green Dragon in that regard. I 
hope those who are interested will try out this new browser based online 
game and take the time to send feedback to the developers. Happy 
adventures, everyone.

[Audyssey] more entombed things

Just wanted too mention a couple of things noticed about entombed for the 
powers that be. grin. 

1. When using harm or lightning, sometimes the damage and the body part hit are 
not mentioned. Damage is done, but for whatever reason nothing else is 
announced.

2. had a fighter and a pet, and fought a zombie. The zombie  was able to be 
hit, and thru the fight managed to mangle all of it's limbs, except his head 
was critical. Basically, the thing was a head and a torso. Well, in attempting 
to finish it off, I was blocked. I thought that it was odd that a limbless 
unmoving target would be hard to hit, I attacked again. Again Imissed or was 
blocked. I did flurry, and my pet attacked it, and I just could not hit this 
thing! I got a bad flashback of a certain black knight in a Monty Python movie 
saying, I'll bite your knees off!. lol
The first zombie I fled from, after whiffing out after a solid dozen or more 
attempted attacks.
Later on I ran into a zombie with the same exact condition. That second one I 
threw various things on it which eventually destroyed it. I then went on to 
explore some new areas and I ran into the same zombie two more times before I  
finally gave up on that game. I know I was in a new area, and that the thing 
didn't have any legs, so I guess that is why I am reporting it here.

No, but that is a bit of a lengthy update. I didn't design the engine 
for automatic weapons so I'll have to redesign the fire code to do that. 
I've just got more important things to work on at the moment such as 
fixing mouse support, adding the game levels, etc.

  With the exception of th e MP5 I don't think an automatic fire is 
realistic.  After all with a 12 gauge shotgun you need to pull th e trigger 
each time.

Hi Will,
I am planning on adding new levels to the game as early as next week. I 
think the game engine is fairly complete now, and I can focus on 
finishing up the game, adding the rest of the levels, etc at this point.
As for when the public will get to actually play those levels that will 
largely depend on if they are on preorder status or not. Thos currently 
on preorder status will be able to play additional levels as soon as i 
complete the game's registration system, and e-mail everyone their 
product keys. However, for security purposes I am holding product keys 
close until I am nearly done with the game. I'd really hate to see 
someone crack, pirate, the game before I even had a chanse to take a 
single new order for it.

Yep. Like War of Thorns. It was just added to the TMC database, and  
it's a web based game that I'll have to check out, for friends tell me  
it has expleration elements.

without the originality. The sub locations don't even have  
descriptions. Pretty much looks like a dragon tavern ripoff, battle  
system, skills, even the perks aside from naming are the same.  
Seems rather hardcore number oriented, which isn't what I was  
expecting, and the strategy element is weird. I'll probably play it  
for a while, but it'll get old just like every other number  
cruncher out there.

Hello everyone. This morning, I played my first cession of  
Legends of Zork. I created my first character, Eldrex. He's a  
recently fired magic sword salesman. I've managed to advance two  
levels and survive my first day's explorations of the dark forest  
near the white house. The game is completely playable for us  
blind Zork fans. However, when it comes to more minor points like  
choosing your character avatar, there are no alt tags on the  
choices. I have no idea whether what I perceive as a buff, rough  
and ready male adventurer is depicted visually as a wafer-thin  
fashion model. The map is certainly functional enough for us as  
the locations near enough to travel to are properly labelled.  
Exploration doesn't rely on seeing anything. You just click on  
the explore the dark forest or a similar link in order to  
search an area and have encounters. It's a lot like Legend of the  
Green Dragon in that regard. I hope those who are interested will  
try out this new browser based online game and take the time to  
send feedback to the developers. Happy adventures, everyone.

well they did say that they will develop it more as it goes along, its not 
supposed to keep one in for more than 20 mins a day its not really a long 
winded thing.
anyway this is only 1.0 or whatever it is so I am sure they are still taking in 
suggestions, and this is only day 1 of the system.

well on topspeed I made a track that was rediculously long.
My reason was not to race, its to long for a real race.
but I wanted to test all the new stupid mods of cars.
the cars themselves are not stupid but really are to fast some of them and some 
are good ideas but take to long to get up to speed.
So I made a track for testing modded cars called fast and furious.
I guess I could have named it test track or something but I was bored one day.
there are no turns, no anything just zoom.
Interestingly some of the mods that I thought wouldn't score well scored faster 
than the actual cars on the track.
Due to the stupditity of the car funracer will be disqualified from any test.
So far the high performance car tops out almost every time.

Hi Will,
I am planning on adding new levels to the game as early as next week. I 
think the game engine is fairly complete now, and I can focus on finishing 
up the game, adding the rest of the levels, etc at this point.
As for when the public will get to actually play those levels that will 
largely depend on if they are on preorder status or not. Thos currently on 
preorder status will be able to play additional levels as soon as i 
complete the game's registration system, and e-mail everyone their product 
keys. However, for security purposes I am holding product keys close until 
I am nearly done with the game. I'd really hate to see someone crack, 
pirate, the game before I even had a chanse to take a single new order for 
it.

There're about 6.5billion mushes, muxes and other such roleplay style things 
out there for just strict roleplay if that's what you're looking for. Seem 
to have become especially popular over the last few months for some reason, 
which is a shame since I'm more mechanically inclined. Anyway both 
topmudsites and mudconnector have a rather huge list of these, and there're 
also some basic RP MOO's out there as well, though a lot of moo's and even 
some mushes lately have been turning toward mechanical backing.

Kingdom of Loathing is supposed to keep you entertained for just a few 
minutes ad ay as well, and they have an entire plot, backstory and 
exploration system. This one's seriously a rebuilt version of dragon tavern, 
almost looks like they got the source code from the DT guys. I'll still play 
now and again cause I admit I've got a bit of an ego for power so I can 
sometimes get into number crunchers, but yeah, this totally isn't zork. I 
hope one of the first things they work on is balance, right now it seems 
there's one, and only one way to get far in the game, and it takes a very 
spacific strategy to pull off. I've hit level 11 and I'm getting pretty 
solidly rocked by monsters that I should be able to at least stand up to, 
with a decent defense and a high attack roll.

Well, I've had a look at the game, but thus far I'm slightly disappointed 
with the lack of description in it, it's just you encountered an X and 
rolled an X nowhere near the richness of the zork games i've played.


I'll carry on with it for a bit though, just in case this is an initial 
problem,  afterall there are lots of areas I stil can't get to.

Hello everyone. This morning, I played my first cession of Legends of 
Zork. I created my first character, Eldrex. He's a recently fired magic 
sword salesman. I've managed to advance two levels and survive my first 
day's explorations of the dark forest near the white house. The game is 
completely playable for us blind Zork fans. However, when it comes to 
more minor points like choosing your character avatar, there are no alt 
tags on the choices. I have no idea whether what I perceive as a buff, 
rough and ready male adventurer is depicted visually as a wafer-thin 
fashion model. The map is certainly functional enough for us as the 
locations near enough to travel to are properly labelled. Exploration 
doesn't rely on seeing anything. You just click on the explore the dark 
forest or a similar link in order to search an area and have 
encounters. It's a lot like Legend of the Green Dragon in that regard. I 
hope those who are interested will try out this new browser based online 
game
and take the time to send feedback to the developers. Happy adventures,

Yeah a role-playing mud would be nice. But I don’t need like total
roleplay, like, you emote everything you do. Those are rather annoying
to me. Are there any that you’d recommend? I know I’m sounding like a
demanding moron. But searching mud connect for blind-accessable muds
has been rather fruitless and now I’m turning to my fellow blindys to
help me out(lol)

What do people have against roleplaying mushes/moos, I will never
understand that.  they're some of the most indept games out there.

I'm roundly disappointed, coming from such a major backstory based influence 
as szork I was expecting more in the way of description,  hay, even KoL 
has more description in combat (pluss manual combat which I always find more 
interesting).


I've played for a while and am level 7, but unless I find more content in 
the game I can see myself dropping this one in short order.

Kingdom of Loathing is supposed to keep you entertained for just a few 
minutes ad ay as well, and they have an entire plot, backstory and 
exploration system. This one's seriously a rebuilt version of dragon 
tavern, almost looks like they got the source code from the DT guys. I'll 
still play now and again cause I admit I've got a bit of an ego for power 
so I can sometimes get into number crunchers, but yeah, this totally isn't 
zork. I hope one of the first things they work on is balance, right now it 
seems there's one, and only one way to get far in the game, and it takes a 
very spacific strategy to pull off. I've hit level 11 and I'm getting 
pretty solidly rocked by monsters that I should be able to at least stand 
up to, with a decent defense and a high attack roll.

well they did say that they will develop it more as it goes along, its 
not supposed to keep one in for more than 20 mins a day its not really a 
long winded thing.
anyway this is only 1.0 or whatever it is so I am sure they are still 
taking in suggestions, and this is only day 1 of the system.

Pretty much looks like a dragon tavern ripoff, battle system, skills, 
even the perks aside from naming are the same. Seems rather hardcore 
number oriented, which isn't what I was expecting, and the strategy 
element is weird. I'll probably play it for a while, but it'll get old 
just like every other number cruncher out there.
