Internet gay sex murder denied

A MAN accused of murdering another man during a sexual encounter 
after meeting him on the internet was mentally ill at the time, a 
Sydney court was told today.


Trent Jennings, 20, has pleaded not guilty in the New South Wales 
Supreme Court to the murder of Giuseppe Vitale, 32, at Narwee in 
Sydney's south, on December 30, 2003.

He offered to plead guilty to manslaughter because he said he was 
suffering from a mental illness at the time, but the Crown would not 
agree to the plea.


His lawyer, Paul Winch, said it was also open to Justice David 
Kirby, who is presiding over the trial without a jury, to find 
Jennings not guilty of murder due to mental illness.


The court was told that Mr Jennings met Mr Vitale in a internet chat 
room and they arranged to meet for sex.
 

Crown Prosector Paul Lynch said Mr Vitale drove to the Narwee flat 
where Jennings was staying and the pair went to a park where they 
had a sexual encounter.


But during the encounter, Mr Jennings became concerned that Mr 
Vitale was going to rape him despite him being tied up, and stabbed 
him, the court was told.


"Mr Jennings told police he freaked out, was fearful for his safety 
and he believed Mr Vitale was about to rape him," Mr Lynch said.


"He got the knife and stabbed Mr Vitale and left the scene."


The trial continues.
