With the holiday season round the corner, tour operators have started enticing
customers with tempting offers, like  ‘Tour of 17 European cities in 15 days’.
Many such offers come with catch phrases like ‘Stay at Hotel Splendour or
equivalent’ and ‘subject to local conditions’.

But how many of the promises made in the tour brochure can the tour operator
bend?

This was decided in an interesting case between Cox & Kings India Ltd and 
Sheila P B. D’souza by the Maharashtra State Consumer Dispute Redressal 
Commission.

The points of dispute were the following:

*The tour skipped Brussels ‘as there was heavy traffic jam in the direction of
that city’

*Food was often served at gas stations and not at restaurants

*Hotels were changed at nine centres and were not as mentioned in the brochure


The consumer was awarded damages of Rs 10,000 and Rs 1,850 as costs.
