[Goanet] INDEPENDENCE OF JUDICIARY IS VITAL

Justice DY Chandrachud who has taken over as the Chief Justice of India on 9
th of this month will have a term of almost two years which should give him
enough time to streamline the judiciary and regain its independence which
his two immediate predecessors strenuously worked towards after the muck
left behind by their three predecessors.

Strengthening the independence of our Judiciary is now on the shoulders of
our Chief Justice Chandrachud. He has a task at hand but it is not a
mission impossible however daunting it may be.  There should be Zero
tolerance to even the faintest governmental interference in the functioning
of our judiciary. Our Constitution of India is very clear on the distinct
roles of the Executive, Legislature and Judiciary. It envisages a free,
fair and independent Judiciary. The highest standards of judicial
independence must always be ensured.

With the sanctity of the other pillars of our democracy currently severely
dented, our only hope is the Judiciary but with the government wanting to
overpower the Judiciary too, there is a very disturbing disquiet over the
slippery slope on which judicial values are slithering.

An effective judiciary guarantees fairness in judicial processes and
transparency. The Public must be confident that the judiciary is beyond
reproach. Transparency is a fundamental component of judicial independence.
Any direct or indirect interference by the politicians in the selection,
elevation and promotion of Judges or even in their transfer is a threat to
the very Independence of the Judiciary.

If the Judiciary is reduced to being a mouthpiece of the government, the
Courts will lose all relevance. It has to be ensured that judicial
accountability is maintained at all times with every Judge conforming to
the highest standards of uprightness and integrity to the Rule of law. If
Judges cannot independently balance the scales of Justice, the Temples of
Justice become pointless.

[Goanet] GLIMPSES OF CHURCH HISTORY

Period 1200 - 1300 CE
Pope Innocent III was crowned in Jan 1198 with the words:
"Thou art Father of Princes, Ruler of the world, Vicar of Jesus 
Christ..."
He garments he wore shone with gold and jewels, and he rode on a 
scarlet-clad horse; his foot was kissed by Prelates and Princes alike.
Within two years, he and not the Emperor was virtual Ruler of Rome and 
Italy.
The Fourth Crusade was launched in 1201 and three years later, the 
Eastern Capital, Constantinople, was sacked, the cathedral desecrated, 
relics stolen and women, including nuns, raped. The Crusader chronicles 
openly refer to the cannibalism practised by the Frankish knights.Kiing 
John of England began taxing the clergy to help fund his wars and 
refused to recognise the Pope who in turn excommunicated John and placed 
all of England under an interdict. King John then confiscated church 
property, banned church services and closed 8000 churches. The Pope then 
asked King Philip of France to invade England. John then gave in and 
promised to pay 1000 marks as annual rent to the Pope in addition to 
Peter's pence.



Having dealt with King John, the Pope authorised a special crusade 
against the Albigensians, a group considered heretical.. The pope 
offered a special indulgence for 40-day service. As a result, a vast mob 
of knights, clergy, peasants etc joined in. The crusaders marched to 
Bezier, looting and killing on the way. The people locked themselves 
into the two main churches. While requiem Mass was being chanted, the 
doors were being hammered down by axes and soon gave way. None were 
spared including babies. The last to go were the two celebrants, holding 
a crucifix and chalice. The invaders then set fire to the town and 
Bezier was turned to a heap of ashes.


Heretics were captured in the hundreds, their eyes gouged out, noses 
lopped off and most were burnt on mass pyres. Meanwhile John of England 
was forced to sign the Magna Carta . But Pope Innocent annulled the 
Charter "from the unlimited power given to me by God".
The Pope passed more laws than the preceding 50 popes. A successor, Pope 
Gregory IX (1227-41) set up the Inquisition to apprehend and punish 
heretics. In 1239, Bishop Moranis of Champagne was accused to allowing 
heretics in his diocese. He and 180 alleged heretics were burnt at the 
stake.


Pope Innocent IV allowed the Inquisition to use torture and decreed that 
disobedience even in thought was punishable. Entire families were 
tortured when a member informed on them. Sentences were also passed on 
the dead and their property confiscated.

 Let us attempt to obtain a view of this gradually disappearing virtue 
– gratitude. Let us ask what is necessary so that gratitude may become 
possible.


   Above all there is this: We can be grateful only to a 
person. Gratitude and petition are possible only between an “I” and a 
“Thou.” We cannot thank a law, a board, or a company. We may do so out 
of mere politeness when the proper sum is handed to us, in order to keep 
everything in the domain of good manners, but real gratitude does not 
enter into the matter, for gratitude is the expression of a personal 
encounter in human need.


   But two persons, one of whom is situated so that he has 
something or can do something, while the other has not or cannot – these 
stand face to face. The one asks and the other is ready; the one gives 
and the other thanks; and the two are united by a human tie. Here 
gratitude is possible, and it becomes a basis for community.


   Furthermore, gratitude is possible only in the realm of 
freedom. For the fact that the sun rises in the morning or, to express 
it scientifically, that the earth comes into such a position in relation 
to the sun that it becomes visible: for this I am not grateful. It is 
certainly true that on a bright morning very lively sentiments of 
gratitude may arise because something so powerful and beautiful is 
taking place. But these are the responses of man to Him who has created 
all, or else they are the after-effects of a time in which the sun 
itself was revered as a divinity. . . . .

Every now and then there's news of the Earth's rotation speeding up by some
tiny slice of time - or slowing down, who knows. In following a trail of
scientific papers after one recent such bit of news, I ran into mention of
something that I had heard about a long time ago and filed away because I
found it so intriguing. Our Earth, it turns out, wobbles.

I love wobbling. (Even the word itself.) So if the Earth wobbles, I'm all
ears. So here's my effort at understanding our planet's Chandler Wobble (my
Mint column for Friday Nov 11).

Let's try an experiment. Take a pencil with a sharp point. Stick it into
the bottom of an orange and push it all the way through, so that the point
emerges from the other end - "diametrically" opposite - of the orange.
Place the point on a sheet of cardboard.

Now twirl the pencil. Watch the orange and the tip of the pencil. What
appears on the sheet? A dot, of course.

Stay with me, this is going somewhere.

Keep that image of the impaled orange in mind while I suggest expanding the
pencil. And the orange. I mean really expanding them, so they become
gigantic. So now I want you to imagine sticking that enormous pencil into
the Earth, at its South Pole. Keep pushing on the pencil until its point
emerges at the North Pole. Push some more, until the point reaches an
equally gigantic sheet of cardboard you're holding just above the North
Pole.

With the pencil touching the cardboard, you stop pushing. But instead of
twirling, you wait for a while; meaning, the Earth rotates on its axis,
which is now marked by your enormous pencil, and that simulates the
twirling.

Question: What appears on the cardboard?

Maybe you're inclined to say, like with the orange, "a dot". With the Earth
rotating, and your pencil as an axis, the point of the pencil makes a small
dot on the cardboard. As the planet rotates, the dot gets steadily darker
and more pronounced. So if you retrieve the cardboard after a day, you
probably think that's what you're likely to see: a dark shiny dot on the
cardboard. Keep it there for longer and the dot will only get shinier.

Except, not quite. You'll see a dot to start with. But as time goes by, the
dot moves. In 24 hours, it will trace a circle with a radius of about 9
metres.

Why a circle?

One way to understand this is to imagine spinning a top. I don't know how
many kids these days have played with this wonderful toy, but when I was a
kid back in the 1920s, it was a popular one indeed. You hold it in one
hand, wind a string tightly around it with the other. Then you throw it
gracefully - either like you would a bowling ball or from shoulder height
downwards - and snap back the string. If you've done it right, the top
should land on the ground on its tip - usually an embedded screw - and spin
rapidly on that point for half a minute or so.

Here's the analogy to our planet. While the top spins rapidly, it stays
almost perfectly upright. If it too had a pencil through its axis and a
cardboard above, the pencil would produce a dot, or a near-dot. But as the
top slows, it strays noticeably from being upright. The point of that
pencil starts moving in a circle that grows steadily larger, until the top
eventually, well, topples.

That's about what's happening with the Earth. Not that its spin is slowing,
but that the axis of its rotation deviates. This is known as the Chandler
Wobble, named for the American astronomer Seth Carlo Chandler (1846-1913)
who discovered it in 1891. It's an example of a phenomenon known as
"astronomical nutation": given an object in space that spins, as many do,
its axis will not stay steady. It will wobble.

The analogy with the top actually goes a little farther. The Chandler
Wobble happens only to rotating objects that are not spheres. Now a toy top
is shaped like a pear, bulbous at one end and pointed at the other - but
certainly the Earth doesn't look like that. In fact, you undoubtedly know
it as a sphere. So why does it wobble, then?

Because the Earth is actually not a sphere. Measured around the equator,
its circumference is about 21km longer than if you measured around the
poles. This makes it an ellipsoid, though it gets more complex still. Add
to the equatorial bulge the innumerable surface irregularities - mountain
ranges here, ocean trenches there. Add the other constant shiftings in its
overall shape - tectonic plates that move, daily tides, earthquakes and
tsunamis and more. All these factors, small as they might be in comparison
to the size of the planet, ensure that its shape is constantly changing.

At any rate, the Earth is not a sphere. Thus she wobbles.

Still, why the wobble at all? Or more to the point, why does the Wobble
persist? A top's wobble, after all, eventually dies out and the top, well,
topples. In fact,

Just a day ago, the Orion spacecraft swung by the Moon - to within a few
dozen km of its surface, in fact. This is the Artemis mission that plans to
take humans back to the Moon - after 50 years! - and then beyond. Think of
that.

I mean, everything about space travel is awe-inspiring. But the very idea
of humans going out there, slipping past the bonds of gravity and flying
free, fills me up with thoughts I sometimes can't even give shape to. I
wonder if some of our distant ancestors had similar thoughts when they
watched compatriots disappear over the horizon of the Pacific Ocean, not
even knowing whether there was land out there, let alone whether they'd
find those tiny specks.

So anyway, that's why I wrote about Artemis and Orion for my Mint column
last week, and I'd love to hear what you think. Especially if you're a Pink
Floyd fan.

My wife was on a flight when I started writing this, on Wednesday morning.
She's always teasing me about my tendency to track her flights, and even
random other ones. No different, today: I was glued to my screen as she
flew. Only, she might be surprised to learn that to my knowledge, there
were half-a-million others and probably many more, watching with me.
Knowing that, she might deduce - with a tinge of disappointment, I hope -
that what I and those others had been following was actually not her flight.

Instead, it was a rocket carrying a spacecraft named Orion - the first of
the Artemis missions, Artemis-I. It lifted off from Florida at precisely
1217 IST, soaring into the sky on pillars of orange fire that turned the
night there nearly into day. Two previous attempts to launch Artemis-I, in
August and September, were aborted at nearly the last minute because of
unexpected leaks. That made this spectacular success all the more
exhilarating to watch. The wait was definitely worth it.

Unmanned Orion is the initial thrust in mankind's effort to return to the
Moon. That is, taking humans there. Next month, it will be half a century
since humans last set foot on our satellite, with the Apollo 17 mission.
That passage of time alone makes the Artemis programme a very big deal. If
Artemis-I is a success, the next mission will carry humans. First, to and
around the Moon. After that, touching down so that humans will roam again
on the Moon.

In fact, Artemis is even more ambitious than that. This return to the Moon
is an initial step in a complex, far-reaching effort to establish a viable
long-term human presence on the Moon. Eventually, mankind will use that as
a base to send humans elsewhere in space. Like Mars.

Big goals. For now, there are lesser, but still necessary and substantial,
steps that Orion will take. Consider this. It will travel some 450,000km
from the Earth. At its furthest, it will be about 65,000km beyond the
"other" side of the Moon - which we Earth-bound humans never see. This is
the deepest into space that any mission designed to ferry humans has ever
penetrated.

>From there, Orion will return to Earth. Whether it can do so safely is a
major part of this test. Apart from whatever the long journey itself throws
up, if anything, it has to re-enter the Earth's atmosphere. It will be
travelling at about 40,000kmph when that happens. Friction with the
atmosphere will slow it to about 500kmph. That kind of friction produces
extreme heat, so Orion is protected by a heat shield. It will have to
withstand temperatures reaching nearly 3000 degrees Celsius.

Once it does that, Orion will deploy a total of five parachutes. Those will
slow its descent down to about 30kmph. Then it will splash gently into the
Pacific Ocean off the coast of southern California.

And if all that isn't complex enough, there are the intricate manoeuvres
that make this journey possible to begin with. For this is not like
shooting a bullet at the Moon. Instead, the craft uses both celestial
bodies' gravities to "catapult" itself through space.

After take-off, Orion orbited the Earth, deployed arrays of solar panels to
tap the Sun's energy, and then initiated a "Trans Lunar Injection Burn".
Riding the momentum built up from the orbit, Orion fired its engines for 20
minutes, enough to escape Earth's gravitational pull and set a course for
the Moon. That's the first catapult.

With the TLI Burn finished, Orion separated itself from the rocket
mechanism ("stage") that set it on this precise Moon-bound path. But that
stage had more work to do. It deployed several "CubeSats", tiny satellites
weighing just 2kg each. They will study the Moon or be set to other tasks;
there are already close to 2000 such miniature satellites in space.

But back with Orion, things get even more interesting as it nears the Moon.
