He Who Must Be Destroyed At All Cost, in solitary imprisonment at Sungei

Buloh, is the Prime Minister's Achilles' Heel.  In the fascist
governance he presides, this spreads down the line to the bottle
washers, in politics and administration, in shock and fright.  The Prime

Minister is so incensed the world and, now, his own people, disbelieve
his claim that the former deputy prime minister's humiliation on
unprovable (and unproven) charages of corruption and sodomy is criminal,

not political.  Worse, the more the judiciary rubs his nemesis's nose
into the ground, the less credible the Prime Minister is.  So, his
choicest barbs are reserved for those countries and leaders who reject,
and protest at, his condescendingly arrogant explanations in public on
why his former deputy continues to be humiliated and harrassed.  The
countries he attacks -- the United States and Australia -- questions,
and so Washington, DC and Canberra is excoriated for their treatment of
their aboriginals.  The Prime Minister is right about Australia's
condescending and bullying presence in Asia, in an Australian television

programme, but he made it to attack Canberra's concern over Dato' Seri
Anwar's predicament.

     Similarly, President Joseph Estrada's hero-worshipping liking for
the Mahathir nemesis complicates Malaysia's problems with the
Philippines to get the kidnapped Sipadan foreign tourists and Malaysians

off the Abu Sayyaf irredentist group which holds them hostage.  When in
Kuala Lumpur for the APEC summit shortly after Dato' Seri Anwar's
detention under the Internal Security Act (during which he was beaten to

a pulp, while handcuffed and blindfolded, by the then Inspector-General
of Police within an hour of his arrest), he went out of his way to see
his wife, Datin Seri Wan Azizah Wan ismail.  The Prime Minister's
personal distate for the Philippine president is undisguised;  the
foreign minister. Dato' Seri Syed Hamid Albar, no more than the Prime
Minister's loyal poodle, parrotting his worldview as the country's, to
ensure Malaysia's diplomatic impotence.  His attack on the chairman of
Indonesia's People's Consultative Assembly, Mr Amien Rais, is not to
annoy Indonesia or Mr Rais, but to prove his loyalty.  The Prime
Minister attacks Mr Howard.  Dato' Seri Syed Hamid attacks Mr Rais.
Cabinet ministers would rather bring Malaysia into headstrong conflict
with a neighbouring country than cause doubts in the Prime Minister of
their absolute loyalty.

     Malaysia does not want foreign governments to extend normal
courtesies to its opposition MPs.  When that opposition MP is the wife
of the He Who Must Destroyed At All Cost, Kuala Lumpur loses all
propriety.  Dato' Seri Syed Hamid attacks Mr Rais for disputing the
official view of Malaysian justice -- with its questionable
prosecutorial and judicial practices, enhanced by a plaintiff's lawyer
colluding with the High Court judge by writing his judgement, and going
on holidays with the Chief Justice and the Attorney-General to
short-circuit justice -- is pristine pure and transparent.  That more
Malaysians disagree frustrates him.  That it brought
Malaysian-Indonesian ties to another roadblock is irrelvant.  Neither
the Prime Minister nor his pet poodle has any affinity with Indonesia.
President Abdurrahman Wahid is incensed, as President Estrada, at Dato'
Seri Anwar's treatment.  Neither has a working relationship with the
Prime Minister because of it.

     Official policy is tetchy at any nation "soft"  on Dato' Seri
Anwar.  The de facto justice minister attacks the recent indictment on
the Malaysian judiciary, "Justice in Jeopardy: Malaysia in 2000" for
"pre-disposed" judgements "and related mostly to Datuk Seri Anwar
Ibrahim's trial and did (not) have the balance to make it a fair and
accurate report."  I thought, after reading it, condescendingly
supercilious, the report more worried about the confrontation the United

Nations has with Malaysia over its Special Rapporteur, Dato' Param
Cumaraswami, and of the DAP former MP, Mr Lim Guan Eng's conviction for
sedition, important as the cases are, but the report should have
concentrated on the deliberate downgrading of justice with judges more
beholden to lawyers and deliberate breach of long held precedent to
frighten those who might confront with millions of ringgit in defamation

action.

     Ultimately, the credibility of the judiciary would stand on not
whether a UN rapporteur is denied his immunity or an MP unfairly jailed,

but on the deliberate breach of rules, including the most blatantly
pernicious -- the Court of Appeal ruled plaintiffs need not prove their
case, an extension of the principle in the Tan Sri Vincent Tan v M.G.G.
Pillai defamation case, and which the Federal Court refuses to confirm
or reject 29 months after hearing arguments -- that reduces Malaysian
justice to those lawyers close to the Chief Justice, it mentions in
passing.  What saves the report is the discussion of Dato' Seri Anwar's
case.  But Dato' Rais attacks the report for his government's own
failings:  Malaysia did not have a chance to rebut the report because of

internal shortcomings, the result of the deliberate devalation, over the

past 19 years, of the institutions of governance. He is more interested
in scoring debating points.  Exceeding it would be bad for his political

health.  As for Dato' Seri Syed Hamid, if he does not bark to please his

Master.  But unnerving to all is the ghostly presence of the Prime
Ministerial Achilles' Heel.
