CAIR today announced that a Muslim New York State Park Police officer who was suspended for wearing a beard will receive more than $25,000 in back wages and will be rehired at his old salary. The State Park Police have also agreed to change their regulations so that officers may request religious exemptions to that force's no-beard policy. (see http://www.newsday.com/coverage/current/news/wednesday/nd6068.htm) In June of last year, CAIR called for the immediate reinstatement of the officer who was suspended without pay for refusing to shave what he regards as a religiously-mandated beard. The officer, who converted to Islam after joining the park police in the early 1990s, told CAIR he was asked to surrender his gun and badge after his request for religious accommodation was denied. "Cases like this are making history for Muslim rights in America. This particular settlement sends a message to law enforcement agencies nationwide that officers may maintain their religious convictions while serving the public in a professional manner," said CAIR Communications Director Ibrahim Hooper. In a related case, the Justice Department on Tuesday sued the city of Newark, N.J., saying it is discriminating against Muslim police officers who wish to wear beards. The lawsuit asks for an order forcing the city to end religious discrimination and to pay compensation to any officer who was the target of bias. Last fall, a U.S. Supreme Court decision left intact a lower court ruling supporting the right of two Muslim New Jersey police officers to wear beards. The earlier ruling, issued by the United States Court of Appeals for the Third Circuit, said the Newark Police Department's no- beard policy was discriminatory because it allowed medical but not religious exemptions.
