Prosecutor says Anwar aims to ridicule Mahathir in sex trial


KUALA LUMPUR, April 18 (AFP) - Prosecutors in Anwar Ibrahim's sodomy
trial
urged the high court Tuesday to reject a bid to have Prime Minister
Mahathir Mohamad testify, saying the ex-deputy premier aimed to ridicule

Mahathir.

But Anwar's lawyers maintained that the premier was a crucial witness,
saying that Mahathir should not be suspicious of their motive and told
him
to be as "brave as (US) President (Bill) Clinton before the grand jury."

Justice Arifin Jaka said he would rule Friday whether to allow Mahathir
to
be summoned as a defence witness.

Anwar, sacked by Mahathir in September 1998, was jailed for six years
last
April for abusing his powers to cover up allegations of sexual
misconduct.
He is now on trial for sodomy, punishable by up to 20 years in jail.

In his affidavit, Anwar said the premier led a conspiracy to topple him
"through fabrication of charges, using government machinery."

The premier, in his affidavit, said he believed Anwar was guilty of
sodomy
but had no knowledge or evidence of any political plot. He said his
testimony was irrelevant to the sodomy hearing.

Earlier, prosecutor Abdul Gani Patail warned Arifin that the court might
be
turned into a political arena if Mahathir were summoned.

Gani said Anwar's affidavits to have Mahathir appear as a witness were
"very scandalous" and contained "baseless and irrelevant" accusations
against the premier.

"We submit that the intention to call the prime minister is only to
ridicule and scandalise the witness," he said.

"There is a real danger that this would allow the court to be used as a
political forum to vent their frustration concerning their political
career
without due regards to the process of law.

"The defence has failed to show any relevancy. We urge Your Lordship to
set
aside the subpoena," Gani added.

But defence counsel Karpal Singh told the court that Mahathir himself
had
repeatedly said in public that he was prepared to testify in court if
necessary.

"The prime minister should not be unduly suspicious of our motives. He
should be as brave as President Clinton before the grand jury," he said.

Karpal urged prosecutors not to shield Mahathir from attending the trial
as
it would deny the defence of relevant evidence.

If the premier is summoned, other politicians named as conspirators by
Anwar such as Finance Minister Daim Zainuddin, and Trade and Consumer
Affairs Minister Megat Junid Megat Ayob could also be called, he said.

Daim is also challenging a subpoena for him to appear as a witness.

Karpal said the defence was not worried that Mahathir's testimony may be

damaging for them.

"We have his sworn affidavit. He cannot say something different. He can
be
charged for perjury and go to prison," he added.

Earlier Tuesday, Anwar condemned a police clampdown over the weekend to
block a mass gathering by his supporters in the city centre and called
for
immediate and unconditional release of all the detainees.

"I regret the harsh and violent action by police to foil the peaceful
gathering," Anwar said in a handwritten note given to reporters by his
family members during the trial.

He said several people who were not involved in the gathering had been
arrested, while the office of the National Justice Party (Keadilan)
headed
by his wife had been raided.

"Police have used this opportunity to oppress political parties and
activists that criticise the government," he added.

About 50 people who were detained, including three Keadilan leaders,
were
Monday remanded to assist a police probe into the protests to mark the
first anniversary of Anwar's sentencing.

Police used water cannons and teargas Saturday to disperse protesters.
Heavy security foiled plans for a mass rally and a march to the palace
to
submit a memorandum on Anwar's case to the king.

The trial continues Wednesday.

Anwar 'attended forum in Bangkok'

KUALA LUMPUR: The former Malaysian ambassador to Thailand told the High
Court yesterday that Datuk Seri Anwar Ibrahim was in Bangkok on Feb 21
to
23, 1993, to attend a forum.

Datuk Zainal Abidin Alias, 56, said Anwar was in Bangkok to attend a
forum
organised by the Chulalongkon University entitled "Towards One
South-East
Asia in the 21st Century."

He said Anwar attended the one-day forum at the Hyatt Erawan Hotel on
Feb
22 and attended a dinner reception hosted by the current Deputy Foreign
Minister of Thailand Sukhumbhand Paribatra.

"Anwar left Penang on Malaysia Airlines Flight MH780 at 1.20pm but I
cannot
remember what his arrival time in Bangkok was," Zainal said, adding that

the then finance minister returned to Kuala Lumpur on a Thai Airways
flight
on Feb 23 at 1pm.

Zainal, who was the defence 24th witness in the Anwar-Sukma sodomy
trial,
had testified to establish Anwar's alibi that he could not have
sodomised
his driver and complainant Azizan Abu Bakar during the alleged period
mentioned in the offence.

Anwar, 52, and his adopted brother Sukma Darmawan Sasmitaat Madja, 38,
are
accused of having sodomised the sacked deputy prime minister's former
family driver Azizan Abu Bakar, 39, at Sukma's apartment at Tivoli
Villas,
Bangsar, here, on one night between January and March 1993.

Sukma, a businessman, is also charged with abetting Anwar in sodomising
Azizan at the same time and place.

The hearing was postponed to today.
