It is a peculiar provision to save the fradulently elected government nominees. How can court decisions be subjected to parliamentary approval, that also by2/3 rd majority ? Shah Abdul Hannan Rulings confirm electoral fraud Court of Cassation rulings recommending that the results of the 2005 parliamentary elections be annulled in some constituencies promise to be a thorn in the side of the NDP's parliamentary majority, reports Gamal Essam El-Din When it opens on 8 November the People's Assembly will have to debate the avalanche of court rulings that have questioned the results of the 2005 parliamentary elections in many constituencies. The Court of Cassation rulings include cases of ballot box stuffing and the intimidation of voters and lend weight to the allegations by several civil society organisations that monitored the 2005 elections that they were marred by widespread electoral fraud. Last week the court said 1,050 appeals had been filed contesting the results of the 2005 parliamentary elections. So far the court has ruled the election results in 90 constituencies in Cairo and the Delta null and void. MPs whose position is affected include several National Democratic Party (NDP) business tycoons and veteran politicians. Last week the court ruled that construction magnate Mohamed Murshidi, NDP candidate for the professional ( fiaat ) seat in the south Cairo district of Maadi, had relied on both the security forces and supervising judges to win the seat. According to the court, Murshidi won just 5,974 out of a total of 22,626 registered votes. Rival candidate Akmal Qortam, an oil tycoon, received 9,648 votes. Yet thanks to the vote- stuffing intervention of the security forces, the court ruled, "Murshidi was declared the winner with a false count of 16,190". In contesting the results Qortam said the presiding judge turned a blind eye to the behaviour of security forces at polling stations and during the count. Murshidi, the NDP's official candidate, is reported to own apartment buildings in which many senior security officers have flats. A similar scenario was repeated in the Daqahliya governorate constituency of Nabarooh. A report issued two weeks ago by the Court of Cassation implicated senior judge Mohamed Siddiq Borhan in a plethora of election irregularities and in manipulating the results in favour of the NDP candidate. The court found that the Wafd candidate Fouad Badrawi had been well on the way to victory before "security forces swooped down on the vote- counting station and began, in coordination with the presiding judge, to change the results." Siddiq first hit the news last May during the confrontation between the independent Judges' Club and the state-controlled Supreme Judicial Council (SJC).He attacked reformist judges Hisham Bastawisi and Mahmoud Mekki, claiming that they had sullied his reputation by including his initials in a list of judges implicated in vote rigging. When the independent weekly Sawt Al-Umma (Voice of the Nation) published the list of initials, Siddiq's name was at the top. As a consequence Bastawisi and Mekki had to face a disciplinary hearing before the SJC. Siddiq has also launched a case against Sawt Al-Umma, on which a ruling has yet to be reached. In the meantime Sawt Al-Umma 's defence lawyer has asked that the recent report of the Court of Cassation condemning Siddiq's role in falsifying Nabarooh's elections be taken into account. The Court of Cassation has also ruled that election results in the Cairo district of Nasr City and Heliopolis, stage of a fierce contest between NDP construction tycoon Mustafa El-Sallab, and the Muslim Brotherhood's Makkarem El-Deiry, a professor of literature at Al-Azhar University, be annulled. The court has yet to hand down judgement in a case filed in Al-Beheira governorate constituency of Damanhour where Mustafa El-Feki, president Mubarak's former secretary of information and currently the chairman of parliamentary foreign affairs committee, fought an uphill battle against Muslim Brotherhood candidate Gamal Heshmat. EID-UL-FITR Hazrat Ibn Abbas(radhiyallahu anhu) says in a lengthy hadith, that he heard Rasullullah(sallallahu alaiyhi wassallam) say:"And the night of Eid-ul-Fitr, the night that is called Laylatul Jaa'izah, (The night of prize giving), comes along. On the morning of Eid Allah sends down the Malaa'ikah to all the lands of the earth where they take their positions at access points of roads, calling out with a voice that is heard by all except man and jinn. "O Ummah of Muhammad(sallallahu alaiyhi wassallam) come forth from your houses towards a Lord that is noble and gracious, who grants much and pardons the major sins". When they proceed towards the places for their Eid salaah, Allah says to the Malaa'ikah: "What indeed is the reward of that employee who had rendered his services?" The Malaa'ikah replies, "O Lord and Master, it is only right that he should receive his reward in full for his services". Allah then says, "I call you to witness, O My Malaa'ikah, that for their having fasted during the month of Ramadhaan, and for their having stood before Me in prayer by night, I have granted to them as reward My pleasure and have granted them forgiveness. O My servants ask now of Me, for I swear by My honour and My greatness, that whatsoever you shall beg of Me this day in this assembly of yours for the needs of the Hereafter, I shall grant you; and whatsoever you shall ask for worldly needs, I shall look at you favourably. By My honour I swear, as long as you shall obey My commands, I shall cover your faults. By My Honour and My Greatness do I swear that I shall never disgrace you among the evil-doing ones and disbelievers. Depart now from here, you are forgiven. You have pleased Me and I am pleased with you. The Malaa'ikah on seeing this great reward bestowed by Allah upon the ummah of Muhammad(sallallahu alaiyhi wassallam) on the day of Eid-ul-Fitr become greatly pleased and happy".(Targheeb, also a similar hadith reported by Anas(radhiyallahu anhu) in Bayhaqi) 1. SUNNATS OF EIDThe following acts are prescribed as Sunnah at the beginning of the day of 'Eid-ul-Fitr before proceeding to the Eid prayer: To wake up early in the morning. To clean one's teeth with a Miswaak. To take a bath(Ghusl). To put on one's best available clothes;ensuring that it conforms with Shariah (sunnah dress). To wear perfume-itr. To eat a sweet food, preferably dates, before departing for Eid Salaat.It was the noble habit of Rasullullah(sallallahu alaiyhi wassallam), not to go out in the morning on the day of Eid-ul-Fitr, till he ate some dates, and he would eat an odd number. (Bukhari) To go to the Musallah-'Eid Gah' as early as possible. To give 'Sadaqatul Fitr' before leaving for the Eid Gah. To perform Eid Salaat on the Musallah-'Eid Gah' rather than the Masjid. There is no harm for aged and the sick to perform their Eid Salaat in the Masjid. To choose a separate route when returning from the Eid Gah. To walk to the Eid Gah. However, there is no harm in using any means of conveyance if the Eid Musallah is a distance away. To recite the following Takbir in the low voice while going to the Eid prayer: "Allahu Akbar Allahu Akbar La Ilaha Ila Allah Wa Allahu Akbar Allahu Akbar Wa Lillahi Alhamd" Offering congratulations: The etiquette of Eid also includes the congratulations and good wishes exchanged by people, no matter what the wording, such as saying to one another Taqabbala Allaah minna wa minkum (May Allaah accept (good deeds) from us and from you or Eid mubaarak and other permissible expressions of congratulations.Offering congratulations was something that was well known among the Sahaabah, and scholars such as Imam Ahmad and others allowed it. There is evidence which suggests that it is prescribed to offer congratulations and good wishes on special occasions, and that the Sahaabah congratulated one another when good things happened, such as when Allaah accepted the repentance of a man, they went and congratulated him for that, and so on.Undoubtedly these congratulations are among the noble characteristics among the Muslims. 2. THINGS TO AVOID: 1) To shave the beards especially for 'Eid. Rasulullah (Sallallaahu 'alaihi wa sallam) has ordered us not to shave our beards; so it is a shame that, on this great day of demonstrating our differences in ceremonies to those of the Mushriks, that some Muslim shaves their beards so that he looks "clean". 2) To imitate the Mushriks in their practices and dress, and to shake hands with women. 3) Free Mixing of Women mixing with men inthe streets and elsewhere, and crowding together with men in those places.This is a source of great fitnah (temptation) and serious danger. The Eid prayer is very important for all Muslims. It has the merits of the five daily prayers as ordained by God for Muslims. It also has the effects of the weekly convention known as `Jumu'ah' and the characteristics of the annual reunions between Muslims. Eid-ul-Fitr (the festival of fast breaking) falls on the first day of Shawwal, the tenth month of the Islamic year, following the month of Ramadan in which the Holy Quran was revealed and which is the month of fasting. The Islamic Eids are unique in every way. To them there can be no similarity in any other religion or any other socio-political system. Beside the highly spiritual and moral characteristics of Eid-ul-Fitr, it has matchless qualities as follows: Eid-ul-Fitr is a wholesome celebration of a remarkable achievement of the individual Muslim in the service of God. It comes after an entire month of absolute fasting during the days of Ramadan. It is a thanksgiving day when Muslims assemble in a brotherly and joyful atmosphere to offer their gratitude to God for helping them to fulfil their spiritual obligation prior to Eid. This form of thanksgiving is not confined to spiritual devotion and verbal expressions. It goes far beyond that to manifest itself in a handsome shape of social and humanitarian spirit. Muslims who have completed the fasting of Ramadan express their thanks to God by distributing alms among the poor and needy on Eid-ul-Fitr. This, as well as oblations, constitutes a major part of the Eids highlights. This Islamic form of thanksgiving is a wholesome combination which can only be found in Islam. Eid-ul-Fitr is a day of remembrance. Even in their most joyful times Muslims make a fresh start of the day by a plural session of worship to God. They pray to Him and glorify His name to demonstrate their remembrance of His favours. Also, they remember the deceased in prayer for their souls, the needy by extending a hand of help, those grieving by showing them sympathy and consolation, the sick by cheerful visits and utterances of good wishes, the absentees by cordial greetings and sincere wishes. Thus the meaning of remembrance of the day transcends all limits and of far-reaching dimensions of human life. Eid-ul-Fitr is a day of victory; the individual who succeeds in securing his spiritual rights and growth receives the Eid with a victorious spirit. The individual who faithfully observes the duties, which are associated with Eid, is a triumphant one. He proves that he holds a strong command of his desires, exercises sound self-control and enjoys the taste of disciplinary life. And once a person acquires these qualities he has achieved his greatest victory, because the person who knows how to control himself and is disciplined in his desires is free from sin and wrong, from fear and cowardice, from vice and indecency, from jealousy and greed, from humiliation and all other causes of enslavement. So when he receives the `Eid', which marks the achievement of this freedom, he is in fact celebrating his victory, and the Eid thus becomes a day of victory. Eid-ul-Fitr is a harvest day. All good workers in the service of God, all the faithful believers reap the fruit of their good deeds on the day, as God grants His mercy and blessings abundantly. The Islamic society, on the other hand, collects the due subscriptions to religious brotherhood and social responsibility, in which subscriptions are paid in the form of mutual love, sympathy and concern. Every member of the Islamic society will be reaping some fruits or collecting some revenue in one way or another. God gives infinitely, especially to those who are sincerely concerned with the general welfare of their fellow believers. Eid is a day of forgiveness when Muslims assemble in the congregation of the day they all whole-heartedly pray for forgiveness and strength of faith. And God has assured those who approach Him with sincerity of His mercy and forgiveness. In that pure assembly and highly spiritual congregation any true Muslim would feel ashamed of himself before God if he holds any enmity or ill feelings towards his brethren. A true Muslim would be deeply impressed by this brotherly and spiritual assembly and would overcome his ill feelings if he had been exposed to any. Consequently he would find himself moving along with others responding to the spirit of the day to purify his heart and soul. This is dedicated to Alia Ansari, who lost her life yesterday in a tragic incident, said Hassan Ansari, Alia's youngest brother, as he choked back tears. She has six kids and a loving husband, and all her family here will miss her very much. About 20 family and friends stood in silence, weeping and staring at the sidewalk where Ansari died as they lighted candles near a growing pile of flowers, balloons and stuffed animals. Ansari, 38, was shot and killed about 2:40 p.m. Thursday as she was walking hand-in-hand with her 3-year-old daughter to pick up her other children from nearby Glenmoor Elementary School, police said. Her charcoal Toyota minivan sat parked outside her apartment Friday. Apparently it had overheated a few days before. Her husband is a mechanic but had been working as many as 12 hours a day and hadn't got around to fixing it, relatives said. Although the exact sequence of events in Thursday's shooting is still unclear, witnesses say a gunman shot Ansari once at point-blank range before fleeing in a small black Toyota or BMW with a spoiler. Fremont police have detained a 27-year-old person of interest in the crime but have not released further details of the investigation. Inside Ansari's home, a small, sparsely decorated, two-bedroom Glenmoor Drive apartment, the wailing and crying of women echoed as male family members stood outside, quietly grieving. Solemn visitors approached Ansari's family, most of whom emigrated to Fremont from Afghanistan, and offered condolences. This is so hard to grasp she was such a harmless person, said Ali Ansari, Alia Ansari's first cousin. We are in shock. I mean, why could this happen to someone so innocent? Khan I AM sure the marvelous social order that prevailed at the time of the Holy Prophet [PBUH] and his right guided Caliphs and generated love and harmony in the society would have never been possible with mere socio political mechanisms of social control and without the backing of personal character and examples of the Prophet and his successors.The Western models of social order and control solely based on its secular character failed to appreciate the effectiveness of personal examples and character of those at the helm of affairs. Man is not a machine or robot. He, by nature, is very much pliable, impressionable, easily influenced by good and bad examples and open to suggestions. Manipulating this basic element in the nature of man, Western media have become highly active to propagate Western market and service economy, over consuming, etc., under the cover of dazzling but shallow Western traits of culture: glittering ads, talk shows, individualism and freedom of all action and _expression_ in the name of democracy. However, in effect it is skillfully tailored to suggest a line of action aimed at achieving some premeditated objectives.Considering mans pliability of nature as immutable, if such things can be achieved then surely with good personal examples and character of the rulers, society could also be put on the right direction. The logic is simple. No social order can be achieved without the cooperation of the rulers and the ruled. This, however, does not say that there is no need for objective state controlled mechanisms for social control and order in an Islamic society.Historically, no society could be ruled harmoniously only by setting personal examples by the rulers, although the charm of the integrity of the personal character of the rulers went always deep into the hearts of the ruled. There has to be some mechanisms effective enough to ensure the smooth and efficient functioning of the society. Mainly two such mechanisms are recognized by the learned experts of the socio political field so as to keep the social order in equilibrium. These two are characterized as consensus and coercion mechanisms or models. Both these models have in them merits and demerits.Merits of the consensus model are inherent in the democratic nature of the social system of a society. It is remarkably appreciated as much better than the coercion model as in it citizens feel freer to discuss national problems and issues. Such a situation constitutes positive social environment in which the importance of the social order is recognized not as a thing enforced from above but as a common need of all the citizens. Such a democratic method of consensus is also the hallmark of Islamic social and political order. In a true Islamic government, we do not see the use of coercion as a customary measure to establish social control and order.After the victory of Mecca, a real Muslim society came into being which then expanded over the whole of Arabia. As long as the Holy Prophet [PBUH] was alive and also during the right guided khilafat of his successors, there prevailed an unparalleled integration in the community representing the best kind of social order of the time. The society under the rule of the Holy Prophet [PBUH] was an exemplary society in the sense that in it the use of coercion for social order was as minimum as could be. Instead, justice, forgiveness and equity were the outstanding features of mechanism of the social order and control.If freedom of _expression_, difference of opinion and disagreement in the temporal world are to be considered one of the most distinct features of democracy, these are not at all new or unique characteristics of modern democracy alone. Going fifteen hundred years back, we see that Islam emerged as a forceful harbinger of democracy both in terms of teachings and practice. As in democracy where consensus is obtained through consultation, Islam too stands for consultation and conference. If we read Verse 38 of Chapter 42 (Al Shoora), it in no ambiguous terms indicates that true believers are those who decide and resolve their matters with mutual conference and consultations. In practice in the Muslim world, this method took the form of an institution popularly known as majlis shoora which could be likened to the institution of parliament of modern times.As regards difference of opinion, there is a saying of the Holy Prophet [PBUH] that disagreement or difference of opinion is a good thing provided that it constitutes appositive value. Incidents of disagreement were not unknown even when the Holy Prophet was alive and he did not discourage those of his companions who disagreed in mundane matters by scolding them or with a frowning look.
