Bismillah [IslamCity] How to ward off Shaytany (Devilish) Whispers

2008-08-30 Thread Mohammed A
Waswas (Insinuating Thoughts) from Shaytan

Question:

"I am suffering from many insinuating thoughts (waswas) about the nature of
Allah, the Almighty, may He, the Almighty, be glorified. There are thoughts
going around in my mind that I cannot utter because they do not fit Allah, the
Almighty, and they keep coming back to me, when I am praying and at other
times. it is so bad that I doubt my faith, and wonder if I am even a real
Muslim or not. What is the cure for this problem?"

Answer:
A number of hadiths have been reported from the Prophet, peace be upon him,
which contain the answer to this problem, Al-hamdu Lillah (praise be to Allah).
The Messenger, peace be upon him, said: "The Shaytan may come to any one of you
and say, 'Who created Allah, the Almighty?' If any one of you experiences this,
let him say, ' 'Amantu billahi wa rasulihi '[I believed in Allah, the Almighty,
and His Messenger, peace be upon him], and that will drive him away." (Saheeh
al-Jami' 1657)

The Messenger of Allah, peace be upon him, also said: "The Shaytan may come to
any one of you and ask, 'Who created the heaven?' and he will say, 'Allah, the
Almighty' then the Shaytan will say, 'Who created Allah, the Almighty?' If any
one of you experiences this, let him say, ' 'Amantu billahi wa rasulih.'"
(Sahih al-Jami' 1656)

The Prophet, peace be upon him, also said: "Whoever experiences anything of
this Waswas, let him say three times,' 'Amantu billahi wa rashullih' and that
will drive the Shaytan away." (Saheeh al-Jami' 6587)

The Prophet, pece be upon him, said: "The Shaytan may come to any one of you,
and say, 'Who created such-and-such? Who created such-and-such?' until he asks,
'Who created your (Lord) Rabb?' If this happens to anyone, let him seek refuge
with Allah, the Almighty, and let him stop such thoughts." (Sheeh al-Jami' 93)

The Prophet, peace be upon him, said: "The people will nearly ask too many
questions, so that one of them may say, 'Allah, the Almighty, created all of
creation, but who created Allah, the Almighty?' If they say this, then recite:
"Allah is the One, Allah is the Self-Sufficient Master, He begets not, nor was
He begotten; and there is none co-equal or comparable unto Him" (Surah 112:
1-4), and spit (drily) to left three times, and seek refuge with Allah, the
Almighty, from the Shaytan." (Saheeh al-Jami' 8182)

The Prophet, peace be upon him, said: "Think about the signs of Allah, the
Almighty, do not think about Allah ( Himself)." (Saheeh Al-Jami' 2975)

The Prophet, peace be upon him, said: "Think about the creation of Allah not
think about Allah (Himself)." (Saheeh al-Jami', 2976)

Form these texts we may summarize the following six ways of overcoming these
insinuating thoughts:

The person who is experiencing such ideas should say," 'Amantu billahi wa
rasulihi [I believe in Allah, the Almighty, and His Messenger, peace be upon
him.]."
He should seek refuge with Allah, the Almighty, from the accursed Shaytan, and
say three times, "A 'udhu billahi 'l-Sami' il-'Alim min al-Shaytan il-rajim,
min hamzihi wa nafkhihi wa nafathih [ I seek refuge with Allah, the
All-hearing, the All-Knowing, from the accursed Shaytan, and from his slander
and evil insinuations]."
He should spit (soft, dry spitting with little saliva) to his left three times.
He should stop thinking about these things, as the Prophet, peace be upon him,
said: "Let him stop." This is an important tactic, because continuing to allow
the Shaytan to influence one in this way will only make it worse. The Muslim
must stop these thoughts, as much as he can, and keep his mind busy with
something useful and beneficial.
He should recite Surah al-Ikhlas (Qul huwa Allahu ahad), because it describes
attributes of the All-Merciful and is considered to be equivalent to one-third
of the Qur'an. Reciting this great Surah will guarantee an end to these
insinuating thoughts.
He should think about the creating and blessing of Allah, the Almighty, not
about His nature, because his weak human mind can never comprehend the nature
of Allah. Allah, the Almighty, said: ". but they never compass anything of
His Knowledge." (20:110)

Bismillah [IslamCity] 4 categories of people

2008-08-30 Thread Abu Jumanah
TheFOUR CATEGORIES OF PEOPLE

Shaykh Saalih al-Fawzaan (may Allaah preserve him) said:
People fall into four categories:
The first categoryis those who are able to made ijtihad in absolute terms, by
referring directly to the Qur’aan and Sunnah and deriving rulings from them,
and they do not follow any other scholars (taqleed).
This is the highest status, but this only applies to the one who fulfils the
known conditions of ijtihaad, by having knowledge of the Book of Allaah and the
Sunnah of the Messenger of Allaah (peace and blessings of Allaah be upon him),
and by having knowledge of Arabic in which the Qur’aan was revealed, and by
having knowledge of al-muhkam and al-mutashaabih (clear, unambiguous texts and
ambiguous texts), al-naasikh wa’l-mansookh (texts which abrogate others and
texts which are abrogated), al-mutlaq wa’l-muqayyad (texts with absolute
meanings and texts with limited meanings), al-khaas wa’l-‘aam (texts with
specific meanings and texts with general meanings).
He should also have knowledge of how to derive rulings, meaning that he should
be qualified. Such a person may engage in ijtihaad. This category includes
people like the four imams – Abu Haneefah, Maalik, al-Shaafa’i and Ahmad – as
well as Sufyaan al-Thawri and al-Awzaa’i. To these people Allaah gave the
ability to engage in ijtihaad.
The second categoryis those who cannot engage in ijtihaad in absolute terms,
but they are able to weigh up the opinions of scholars and determine which is
more correct, because of their knowledge of which opinions are based on
evidence and which are not.
Such a person must follow that for which there is evidence, and shun that which
goes against the evidence. This action is called tarjeeh (weighing up what is
more correct) and is also known as al-ijtihaad al-madhhabi (ijtihaad based on
the study of different views).
The third categoryis those who cannot engage in tarjeeh. Such a person is
regarded as one of the muqallideen (those who follow other scholars), but if he
knows that some opinion has no supporting evidence then he does not follow it.
But so long as he does not know and it is not clear to him that it is contrary
to the evidence, there is nothing wrong with him imitating and following the
opinions of the trustworthy scholars.
The fourth categoryis the one who is unable to do any of the above; neither
ijtihaad in an absolute sense nor weighing what is more correct nor following a
specific madhhab, such as the ordinary Muslim, for example.
Such a person has to ask the people of knowledge, as Allaah says
(interpretation of the meaning): “So ask of those who know the Scripture, if
you know not” [al-Nahl 16:43]. So he should ask the one who be believes is most
trustworthy and the scholar in whom he has the greatest confidence, of those
whose knowledge and actions he trusts, and follow his fatwa.
These are the categories of people with regard to this issue.
What a person should do is know what level he is at, and he should not put
himself in a higher position than he deserves. Indeed, the matter is more
serious than that. He should fear Allaah, because it is the matter of halaal
and haraam, of Paradiseand Hell, so he should not indulge in matters that he
does not have the knowledge and skill to deal with. End quote.

The Prophet (saw) said,
"Whoever sets this world as his goal, Allah divides his affairs for him, He
will place poverty between his eyes, and he will be able to attain nothing from
this world, except for what Allah has already written for him. (In contrast)
whoever sets the Hereafter as his goal, Allah gathers his affairs for him,
gives him richness of (faith in) the heart and the world will come to him

Bismillah [IslamCity] preparation

2008-08-30 Thread Abu Jumanah
How can we prepare for the arrival of Ramadhan?

Praise be to Allaah.
Firstly; You have done well to ask this question, because you have asked how to
prepare for the month of Ramadhan. Many people misunderstand the true nature of
fasting, and they make it an occasion for eating and drinking, making special
sweets and staying up late at night and watching shows on satellite TV. They
make preparations for that long before Ramadhan, lest they miss out on some
food or prices go up. They prepare by buying food, preparing drinks and looking
at the satellite TV guide so they can choose which shows to follow and which to
ignore. They are truly unaware of the real nature of fasting in Ramadhan; they
take worship and piety out of the month and make it just for their bellies and
their eyes.
Secondly; Others are aware of the real nature of fasting in the month of
Ramadhan, so they start to prepare from Sha’baan, and some of them even start
before that. Among the best ways of preparing for the month of Ramadhan are:
1 –Sincere repentance
This is obligatory at all times, but because of the approach of a great and
blessed month, it is even more important to hasten to repent from sins between
you and your Lord, and between you and other people by giving them their
rights, so that when the blessed month begins you may busy yourself with acts
of worship with a clean heart and peace of mind. Allaah says (interpretation of
the meaning):
“And all of you beg Allaah to forgive you all, O believers, that you may be
successful”  [al-Noor 24:31]
It was narrated from al-Agharr ibn Yasaar (may Allaah be pleased with him) that
the Prophet (peace and blessings of Allaah be upon him) said: “O people, repent
to Allaah for I repent to Him one hundred times each day.” Narrated by Muslim
(2702).
2 –Du’aa’ (supplication)
It was narrated from some of the salaf that they used to pray to Allaah for six
months that they would live until Ramadhan, then they would pray for five
months afterwards that He would accept it from them.
The Muslim should ask his Lord to let him live until Ramadhan with a strong
religious commitment and good physical health, and he should ask Him to help
him obey Him during the month, and ask Him to accept his good deeds from Him.
3 – Rejoicing at the approach of the blessed month
The arrival of Ramadhan is one of the great blessings that Allaah bestows upon
His Muslim slave, because Ramadhan is one of the occasions of good in which the
gates of Paradiseare opened and the gates of Hell are closed. It is the month
of the Qur’aan and of decisive battles in the history of our religion.
Allaah says (interpretation of the meaning):  “Say: ‘In the Bounty of Allaah,
and in His Mercy (i.e. Islam and the Qur’aan); —therein let them rejoice.’ That
is better than what (the wealth)  they amass” [Yoonus 10:58]
4 – Discharging the duty of any outstanding obligatory fasts
It was narrated that Abu Salamah said: I heard ‘Aa’ishah (may Allaah be pleased
with her) say: I would owe fasts from the previous Ramadhan and I would not be
able to make them up except in Sha’baan.  [Narrated by al-Bukhaari (1849) and
Muslim (1146).]
Al-Haafiz Ibn Hajar (may Allaah have mercy on him) said: From her keenness to
do that in Sha’baan it may be understood that it is not permissible to delay
making them up until another Ramadhan begins.  [Fath al-Baari (4/191).]

5 – Seeking knowledge in order to be able to follow the rulings on fasting and
to understand the virtues of Ramadaan.
6 – Hastening to complete any tasks that may distract the Muslim from doing
acts of worship.
7 – Sitting with one’s family members – wife and children – to tell them of the
rulings on fasting and encourage the young ones to fast.
8 – Preparing some books which can be read at home or given to the imam of the
mosque to read to the people during Ramadhan.
9 – Fasting some of the month of Sha’baan in preparation for fasting Ramadhan.
It was narrated that ‘Aa’ishah (may Allaah be pleased with her) said: The
Messenger of Allaah (peace and blessings of Allaah be upon him) used to fast
until we said: He will not break his fast, and he used not to fast until we
said: He will not fast. And I never saw the Messenger of Allaah (peace and
blessings of Allaah be upon him) complete a month of fasting except Ramadaan,
and I never saw him fast more in any month than in Sha’baan.  [Narrated by
al-Bukhaari (1868) and Muslim (1156).]
It was narrated that Usaamah ibn Zayd said: I said: O Messenger of Allaah, I do
not see you fasting in any month as you fast in Sha’baan? He said: “That is a
month that people neglect between Rajab and Ramadhan, but it is a month in
which people’s deeds are takenup to the Lord of the Worlds and I would like my
deeds to be takenup when I am fasting.”  [Narrated by al-Nasaa’i (2357);
classed as hasan by al-Albaani in Saheeh al-Nasaa’i.]

Phenomenon of Islamic ’Justice and Development’ Parties

IkhwanWeb - Egypt

Wednesday, August 27, 2008
Hossam Tammam*

In its history in political work, the identity issue overwhelmed the Islamic
movement and was a top priority for issues like Islamic state, rule of Islam
and applying Sharia (Islamic law). These identity-oriented issues were the core
of any political slogan or party platform they may propose. Even when political
or legal restrictions prevent them from making public the identity issues, they
have been including them in their slogans, speeches and platforms like Turkish
Islamic leader Necmettin Erbakan who was forced by the strict legal
restrictions in the Kamalist secular system to raise the slogan of building a
fair system and bringing the country back to the age of glory and prosperity.
Everyone knew that he implicitly means establishing the Islamic system that
applies Sharia and restores the Caliphate.

In this context, Islamic parties have been keeping in their memory the issue of
identity not only in their programs but also in their names. The most
well-known parties have names which either directly reflect their Islamic
identity like "the Islamic Party" in Malaysia, " the Islamic Action Front " in
Jordan or "the Islamic Salvation Front" in Algeria . Or they give a priority to
a pillar of the Islamic project like "Sharia Party" (an Islamic party draft in
Egypt), "Virtue Party" in Turkey or "Movement for the Society of Peace" in
Algeria.

However, a decade ago, the phenomenon of Justice and Development parties
emerged to put justice and development issues a central position in their
discourse and names as well. The phenomenon started in Morocco with the
establishment of the Justice and Development party (PJD) in 1998 to extend to
the Arab and Muslim world in the shape of parties which are already founded and
others which are still under construction. In Turkey, the middle generation in
the Islamic movement established a party with the same name Justice and
Development (AK Party); in Indonesia, Islamists established the party of
Justice and Development and in Malaysia Anwar Ibrahim, the former leader of
the movement of Muslim Youth, founded a new party named the Keadilan party, or
the People"s Justice . In Iraq, a Shiite Islamic group adopted the idea and
established a party named Justice and Development, although it is still in the
sidelines of the overall Islamic scene in the political scene in general. In
Mauritania, Islamists established "The National Gathering for Reform and
Development", another variation of Justice and Development coined by their
Moroccan Islamic neighbours. It has a charisma and influence in the Mauritanian
Islamic case. There is also a botched attempt in Bahrain, and another one in
Egypt, in a group on the margin of the Islamic movement but were rejected by
authorities. All of them are parties or drafts of parties bearing the name of
Justice and Development which emerged from the Islamic movement in their
countries.

We are seemingly facing a phenomenon that needs to be studied specially that it
presents questions more than answers. The first question is why this
name-Justice and Development-mushrooms in drafts of Islamic parties, while
traditional names related to the core of the Islamic ideology like Al-Umma
(Nation), Sharia (Islamic Law), Al-Islah (Reform) and Al-Nahda (Renaissance)
retreated. This change may be with a bigger and a deeper shift that the Islamic
phenomenon has witnessed in the past two decades. This shift moved it from a
political platform to a social platform as a part of the changes in the Islamic
and Arab societies, and changes all over the world which is witnessing the
waning or end of ideologies. In the midst of this change, the social platform
and its slogan (justice and development) have become more attractive and more
powerful to pave the way for these Islamists towards power. We can also link
between this phenomenon and what took place throughout the last decade,
including reviews inside the Islamic discourse mostly related to the Islamic
vision of the idea of a state and its excessive sensitivity to the issue of
identity. Most of these reviews were carried out under pressure of the secular
criticism to the Islamic political discourse accusing it of using hollow
slogans and ideology. However, the phenomenon can be at the same time linked
with increasing demand especially in the West and the United States for
"Moderate Islam" whose characteristics of moderation are determined with
abandoning the political and coming closer to the social and developmental.

Finally, the phenomenon has a confirmed link with social and class changes
inside components of the Islamic movement itself that generally witnessed a
social tide on the one hand and coming closer to people, their cares and
interests on the other ha

Bismillah [IslamCity] Woman wearing veil told to leave Italian museum

Woman wearing veil told to leave Italian museum
By Philip Pullella

Wed Aug 27

The head of one of Venice's most prestigious museums apologized on Wednesday to
a Muslim woman asked to leave the building by a guard because she was wearing a
veil over her face.

The episode, which has kindled controversy in the Italian media and arguments
between centre-left and centre-right politicians, occurred on Sunday in
Venice's Ca' Rezzonico museum, which houses 18th-century Venetian art.

"I'm sorry for what happened and if she ever wants to return to our museum, she
will be more than welcome," director Filippo Pedrocco told Reuters by telephone
from Venice.

The woman, visiting the museum with her husband and children, had cleared
security when she entered the building.

When she reached the second floor, a room guard told her she must remove her
"niqab," which leaves only the eyes visible, or leave.

"The room guard was over-zealous. He should not have done it. She already
passed security and his only duty was to guarantee the safety of the artwork in
his room," Pedrocco said.

The woman was believed to have been a member of a well-off family visiting
Venice from Saudi Arabia or a Gulf state.

She refused to take off the veil and left the building, which faces Venice's
Grand Canal and houses works by such 18th century Venetian masters as
Giandomenico Tiepolo.

Italian anti-terrorism laws dating from the 1970s ban the wearing of face
coverings in public but they are rarely enforced in cases of Islamic veils.

Italian media reported that the guard, who Pedrocco said worked part-time and
was employed by an outside security firm, would be disciplined and risked being
fired.

However, the guard, whose name was not disclosed, was hailed as a hero by some
in the Veneto region, where there has been tension between long-time residents
and Islamic immigrants.

Senator Roberto Castelli, a member of the anti-immigrant Northern League, asked
the justice minister to make sure the guard was not disciplined or sacked "for
doing his duty and making sure the law was respected."

Giancarlo Gentilini, deputy mayor of the city of Treviso north of Venice, said
the guard should be "given an award and not punished."

The Hon'ble Prime Minister of India

27.8.2008

Dear Dr Manmohan Singh,

Gujarat 2002 is being repeated in Orissa right now. The minority
under attack has changed from the Muslim to the Christian. The
perpetrators remain the same. The Vishva Hindu Parishad and various
other Sangh outfits.

Knowing their track record of violence from earlier in Orissa as
well as in other parts of the country there is nothing which could
not be foreseen. The kind of violence and mayhem which they have
done in the past and which they are capable of organising is an open
secret. Every Bandh call given by the VHP, RSS and the whole Sangh
combine has always resulted in large scale violence any where in the
country.

Every time a new excuse is created and used by the Sangh outfits as
a reason to attack either the Muslims or the Christians. Sangh is a
past master in creating enough reasons to attack the minorities is
an established fact.

The Sangh is wreaking havoc in Orissa. Schools, orphanages, churches
are being attacked, damaged, vandalised. Pastors and priests are
being killed and nuns raped and set ablaze. Properties of hundreds
of Christians have been burnt down, looted, vandalised. People are
hiding in the forest and are witnessing their homes and businesses
being burnt. Smoke is rising from all over.

We are witnessing on one hand total failure of the government
machinery to control the violent Sangh outfits on the other hand we
are witnessing the connivance to save the Sangh. Every past incident
has seen the minorities being attacked by the Sangh and then all the
cases being filed against the minorities. There is a conspiracy of
silence by the government on how minorities are being hounded in
India. Golwalker's agenda of reducing the minorities to second class
citizens in this country is in full swing and everyone is partnering
in this agenda. Hundreds of innocent people are being picked up,
tortured in the name of fighting terrorism.

I am writing to you with the request to intervene immediately,
deploy enough central forces to stop the mayhem and violence in
Orissa.

Bismillah [IslamCity] [QURAN - Part 7] Sajda Tilawat

 Sajda Tilawat

THE AYAT OF SAJDATUT TILAWAT
There are 14 Aayaat of the Qur'an after the recital of which Sajdatut
Tilawat has to be made. These are indicated by the word 'As Sajdah'
shown in the margin and also on the specific Aayaat. (Note: The second
Sajdah in Surah Haj is to be performed by the Shafi'ees, and the
Sajdah in Surah Saad is not a Sajdatut Tilawat for the Shafi'ees. This
is a Sajdatush Shukr for the Shafi'ees and should be performed only
out of Salat. The niyyah(intention) for this is: 'Nawaytu Sajdatush
Shukri lillahi Ta'aala').

According to the Shafi'es and Hanafis there are 14 sajda tilawat in
the Noble Quran. The Hanbalis state that there are 15 sajdas whilst
the Malikis say that there are eleven sajda tilawat in the Noble
Quran.
When reciting or listening to the Qur'an and on reaching any of these
Aayaat it is Waajib to perform a single Sajdah, according to the
Hanafi's. According to Imaam Shafi'ee Rahmatullahi Alayh it is Sunnah.
The Hanafi scholars say that it is compulsory upon the reciter and
listener to perform the 14 sajdas. The vast majority of jurists,
namely, Malikis, Shafi'es, Hanbalis state that it is sunnah and not
compulsory. However if one is unable to perform the Sajdah at once
then it could be performed soon after. This Sajdah is not Waajib for
women when they are in a state of Haidh or Nifaas.

If an Aayat of Sajdah is read in Salaat then the Sajdah must be made
immediately in the Salaat. The method of performing Sajdatut Tilawat
in Salaat is to complete the Aayat and then immediately go down into
Sajdah whilst saying Allahu Akbar. After the Sajdah return to the
standing position whilst saying Allahu Akbar and continue recital
without first reading 'Bismillah'.

If an Aayat of Sajdah is repeated several times while seated in one
place then only one Sajdah is Waajib. When one Sajdah Aayat is read at
several different places or if separate Aayaat are recited at various
places then the corresponding number of Sajdahs will have to be
performed A small house, or the chamber of the Masjid is regarded as
one place. It is desirable to read the Aayat of Sajda inaudibly to
avoid making the Sajdah Waaj'ib on others who are within hearing
distance. It is makrooh to recite the Qur'an and deliberately omit
reading the Aayat of Sajdah to avoid performing the Sajdah.

HOW TO PERFORM THE SAJDATUT TILAWAT
The same conditions regarding Tahaarat, Wudhu etc. that apply to Salat
are applicable to Sajdatut Tilaawat. Sajdatut Tilawat is prohibited
whilst the sun is rising, precisely at noon, and from the time the
colour of the sun changes before sunset until the sun has fully set.

The Hanafi method: It is Mustahab (desirable) to stand up and say:
'Allahu Akbar' without raising the hands; then go straight down into
Sajdah; read 'Subhaana Rabbiyal A'ala' three times; arise out of
Sajdah and 'whilst standing up say; 'Allahu Akbar'. There is no
Tasleem (Salaam) after standing up. Although it is better to begin and
end this Sajdah from a standing position, it is also correct to
commence and terminate it from the Jalsa (sitting) position.

The Shafi'ee method:
First say the niyat for Sajdatut Tilawat thus: 'Nawaytu Sajdatut
Tilaawati lillahi Ta'ala' . Then recite the Takbeeratul Ihraam(whilst
lifting hands as in salaat) by saying 'Allahu Akbar' and perform one
sajdah. Thereafter whilst standing up say the Takbeer (Allahu Akbar)
and then recite the Tasleem(salaam) to complete the sajdah.

Assalamu Alaikum:

While Ramadan is a time to boost our personal spiritual batteries, it's also a
critical occasion to help our families do the same.

It's important to include our parents, spouses and children in our Ramadan
plans this year. That means not only having Iftar together or attending
Taraweeh prayers with them. It means really sitting down and making time for
each other to make Dua as a family, for example, taking the time to give our
children's teachers a factsheet about Ramadan so they can familiarize
themselves with this special time in our kids' lives or giving our spouse a
half hour every evening or morning to offer a few more extra prayers or to read
a few more verses of the Quran.

This week, find out how you can help make Ramadan a spiritually enriching month
for not just yourself, but your loved ones as well.

Peace
Sound Vision team

Bismillah [IslamCity] U.S soldiers bring liberty to Iraq by executing Iraqis

2008-08-30 Thread Shahid
U.S. soldiers say they executed Iraqis on riverbank: report
Three U.S. soldiers killed four handcuffed and blindfolded Iraqi prisoners with
pistol shots on the bank of a Baghdad canal last year, the New York Times
reported on Wednesday.

Sergeant First Class Joseph P. Mayo, the platoon sergeant, and Sergeant Michael
P. Leahy Jr., Company D's senior medic and an acting squad leader, made sworn
statements in January to Army investigators in Schweinfurt, Germany probing the
incident, the newspaper reported on its website.

The men each described killing one of the Iraqi detainees, as directed by First
Sergeant John E. Hatley, according to the statements. Hatley shot two other
detainees with a pistol in the back of the head, Mayo and Leahy told
investigators, according to the NYT.

U.S. soldiers cannot harm enemy combatants once they are disarmed and in
custody, the NYT said.

A spokesman for the U.S. Army in Europe declined to comment, saying he could
not speculate on any future legal action.

David Court, the lawyer in Germany named by the NYT as representing Hatley, was
not immediately reachable.

According to Leahy's statement, cited by the NYT, Army officials directed
Hatley's convoy to release the men because there was insufficient evidence to
detain them.

"First Sergeant Hatley then made the call to take the detainees to a canal and
kill them," as retribution for the deaths of two soldiers from the unit, Leahy
said in his statement.

"So the patrol went to the canal, and First Sergeant, Sgt. First Class Mayo and
I took the detainees out of the back of the Bradley (fighting vehicle), lined
them up and shot them," he added, according to The Times. "Then we pushed the
bodies into the canal and left."

After the men were killed, Hatley told Leahy and Mayo to remove the Iraqis'
bloody blindfolds and plastic handcuffs, according to the newspaper. The three
soldiers then shoved the bodies into the canal and drove back to their combat
outpost, the paper said.

No charges have been filed against Hatley, Mayo or Leahy -- all from Company D,
First Battalion, Second Infantry, 172nd Infantry Brigade.

However, four other soldiers have been charged with conspiracy to commit
premeditated murder relating to an incident that occurred last year in Baghdad,
the U.S. Army in Europe said in a statement last month.

A hearing in that case opened on Tuesday and is still going on in the southern
German town of Vilseck, the U.S. Army spokesman said on Wednesday.
