Since I sensed your urge for answerswas genuine, I took the liberty of forwarding your questions to one Janab Mirza Yawar Baig Sahab. Janab Yawar is the closest I have come across to being a perfect blend of Duniya and Deen. He is IIM topper, Management Consultant, Leadership Trainer and an Islamic Scholar. He was so kind as to send answers to your questions as under:

1. How is our authoritative scholar's legitimacy established? 

Just like the legitimacy of any technical expert is established. Ask where he studied, what is his aqeeda, what is the level of his qualification, does he know Arabic and what has he specialized in. 

2. Who are they today?

Anyone who satisfies the above test
3. Is it obliging for the individual Muslim to obey them even against his/her own common sense or judgment? 

Common sense or judgment of a person who is not an expert in a particular area is not something that can be relied upon. You would not use common sense or judgment to medicate yourself or to design your own house or to conduct your own legal defense or to build a business. So why would you want to use common sense or judgment without content knowledge or expertise when it comes to Islamic knowledge. This knowledge is like any other knowledge. You need to study it in detail and in depth and to practice it before you can take the step of using judgment. And once you do that, then your judgment is no longer 'common'. It is expert judgment. And that is okay to use.

4. Are we always under their jurisdiction regardless of where we live?

Will you read what has been written in a medical journal in America and medicate yourself? Or would you go and see your local doctor? But you would still read the medicaljournal and compare what your doctor says, especially if he sayssomething that is dramatically different. You would then ask him to explain hisdiagnosis or line of treatment in the light of what other experts in the world have published.


Same rule. Build relationships with local Ulama and ask them to help you to understand Islam and to practice it. It is not a question of over or under. Nobody is under anyone in Islam. We are all independent to take our own decisions and are responsible for their consequences. You are free to disobey all religious rulings and to live your life according to your desires as long as you are agreeable to the consequences. It is just like someone who protests about being 'under' the doctor who advises him or her to stop smoking. Such a person is not 'under' the doctor. They are free to keep on smoking and to die a horribly painful death which they actually paid for and bought. Your choice how you want to look at advise that is for your own benefit.

5. There are examples in Ahadith that point at the permissibility of questioning authorities. Wouldn't that establish the principle that authorities should be under surveillance and therefore find support in the Muslim population?


Sure, you are welcome to question. And it is the duty of those you question to explain the logic and basis of their rulings. However there is a difference between questioning and rebelliousness. Let us remember that. And in the final analysis, as I have said above, you are still free to disobey the rulings. As they say, its your life; both in this world and in the hereafter. 


Pardon me for pointing out that there are even more examples in the hadith and in the Qur'an of unquestioning obedience. Read the last 3 ayahs of Sura Al Baqara and the ahadith that are quoted in their tafseer (Ibn Katheer).Should this also find support in the Muslim population, you think?

6. Are both the Shari'a law-stem and scholars later and contemporary conclusions obliging for every Muslim regardless of where he/she lives and regardless of the community having a Khalifat or not?

7. Will Islam ever become State apparatus with Shari `a laws application and Khalifat on earth before the end of times?

Aha!! I have no knowledge of the future my sister. Only Allah knows. The real question is, do you want Islam to become 'State apparatus' as you call it and for Khilafat on earth? If so, what are you intending to do about making that happen. Remember we will not be asked, What happened? We will be asked, What did you do?
