Ok, so I've managed to write a kernel driver, as an extension to
psmouse, which recognises the touchpad and puts it into gesture-enabled
mode. Currently it recognises and uses vertical and horizontal two
finger scrolling, and also knows about the other gestures (but I haven't
got around to

Gesture recognition is done by the touchpad and not the driver, and it's
not very good. I.e., it reports the gesture, not the finger positions,
so we can't configure things like scroll threshold.
The way to improve this would be to somehow put it in 'absolute' mode,

Testing upstream kernels will not help with this issue as Ubuntu carries
a newer version of apparmor than is currently upstream. From the back
trace it is clear to me that the bug is in the newer code that ubuntu is
carrying. I am working on a patch and have a test kernel building.

I've written a basic program that surfaces this bug. To recreate:
$ cd /tmp
$ tar xvf bug-1429756.tgz
$ cd bug-1429756
$ make
$ ./bug-1429756.sh
loop 1
loop 2
ERROR: got failure scenario after 2 loops (got=16, count=17,
log=/tmp/tmp.uwZHkHh0mc)
$

this patch fixes kernel crashes with kernels =3.18 for me on BCM43228.
I'm currently using it on top of vivids bcmwl-kernel-source:
6.30.223.248+bdcom-0ubuntu2 and the vivid 3.19.0 kernel
