No, those other kids are the kids of the uncle who is still living. For
some wierd reason, she had it so of that particular house was sold, my
mother got half, and the other half was split 5 ways with my uncle and
his 4 kids. Very strange.

Sounds like a living trust, not a revocable trust.
Just as someone else mentioned, living trusts shield
assets while the grantor is still living so that they
don't become part of the estate. This is a good way to
make sure that minor children inherit real property,
for example.
I had a close frie

Are those other damn grandkids your uncle's offspring, or the
offspring of a deceased aunt/uncle? If the latter, they are
just getting their parent's
My grandmother passed last June.
When my grandfather died in 1986 she planned ahead and had her attorney
arrange a "living trust."
Basically, her two daughters were added to the deeds but she maintained
control during her lifetime. None could mortgage, sell or transfer.
The benefit was that this
I dont have the trust papers in front of me, but IIRC, my grandmother
was listed as the trustee for her own trust, with my mother listed as
successor. This was a revocable living trust I think. Maybe this is
somewhat different than what you are talking about. All I know is that
my mother now
The trust had to have a trustee identified in the
trust documents - this is a legal requirement,
especially because of tax issues. Also, if the trust
was drawn up by an attorney or financial planner, they
would have to be identified in the documents.
You may be confusing term "executrix" for what
Well my grandmother always had these things drawn up and such over the
years, but that last one we found was 98. Like I said, I cant believe
she didnt have her trust revised since then. Im not sure there is a way
to find this out without knowing exactly which lawyer she used. She
could have
Yeah, whoever the trustee is (your mom?) wasn't
keeping things current, which makes it pretty much
useless.
That's why you need a trustee, like an attorney, to
manage it for you. Sure, it costs something, but at
least then it's always current and gets executed the
way you want.
We did this as op
for instance, this thing is from 98, I cant believe she never updated it
in all that time. Most of the property mentioned in it has long been
sold. For some strange reason, I have some cousins in WA who have not
been around here in 10-15 years are getting a cut of one of the houses
