Just following up on this. After the appraisers put their heads together, the payout was over 14k. It was a really nice example with under 100k. Anyway about double the original offer. A common car is easy to total, a “rare” car is not. When the E300D got smacked USAA could not find a local enough comparable, and had to do a nationwide search. In 2013 there fewer than four examples to be had and the lowest was $9800. Argument condensed to an acceptable end result: Hire a law firm to negotiate your position, present real appraisals, and argue with the insurance company. The law firm will tack on their fees to the "proposed settlement figure" with the Insurance company. [presuming law firm prevails, be prepared to eat their fees personally] The law firm will file court documents that take it to a Judge, where the Judge will be presented YOUR appraisals which could include, for example, comparable vehicles sold on BAT, to establish fair market value. Hagerty has a quite knowledgeable appraisal staff, since they insure speciality vehicles. Insurance companies are well versed on how to "bend you over the back fence" to your disadvantage. Engaging your chosen lawyer to speak for you takes it up a notch in your favor [in my personal experience] If you were injured in the damage, the lawyer will incorporate that in the overall arguments also. They literally google the car and find some similar ones listed for sale, then use these as the basis for their comps. If the repair approaches the CCC number, or a certain percentage of it, they seem the car a total loss and Copart starts calling you to get you to release the vehicle from your body shop. Of course this is irritating if you feel you are being lowballed. The comps are supposed to be within 90 days. They do not provide details of the cars condition or mileage. They are supposed to be as close to the damaged car geographically as possible. In my case the comps provided were in Minnesota, Atlanta and I forget the third. One of them was actually an e320, if that gives any indication of the knowledge of CCC appraisers or their attention to detail. USAA decides based on this whether to total the car out. I had a discussion with my agent about this, unfortunately the time to get the car appraised and an agreed value established with the insurance company is before you have a claim. Especially if your car is old enough that there is no real "market value" or if your car is in exceptional condition compared to the "average." Hi All, I need an independent appraiser to assess my e420. It got smashed and USAA is lowballing me, as expected, so I am contesting the value. I already sent them comps for 15,500, 19,000 and 38,000, but apparently that is not good enough. They are at 8,000. If anyone knows a good appraiser that works in California, please let me know. Maybe I will call Hagerty's or something.
