I have downloaded linux-2.6.28 and linux-2.6.28.1 kernel and apply the
patch successfully.
There is no error message when applying the patch.
However, I still get the error message as follow.

Did the patch apply cleanly?
There maybe some conflict which you need to resolve manually
before you can compile.
