Supreme Court judges
explain why Hindmarsh
Bridge appeal failed

The Full Court of the South Australian Supreme
Court says a claim that building the Hindmarsh
Island Bridge, south of Adelaide, is an act of
genocide, had been doomed to failure.

The Court has published its reasons for
rejecting an application to prevent work from
starting on the bridge after yesterday taking 10
minutes to unanimously uphold a Supreme
Court decision to reject the application.

In its reasons, the court said the claim that the
building of the bridge was an act of genocide
was a serious one, but not one that could be
brought under Australian law.

The court was also critical of the lateness of the
action, which came just as work on the bridge
was due to begin.

It says the proceedings could have been
brought during a number of inquiries into the
bridge, including the 1995 Royal Commision, or
at any time since.

The lawyer who argued the case has indicated
he'll be taking the matter to the High Court.
