WASHINGTON - After trying to curb class-action suits for years, Republicans finally 
have enough support to ram legislation through the Senate to limit what they call an 
overabundance of frivolous cases against American businesses. But a decision by Senate 
Majority Leader Bill Frist to push forward immediately on that legislation instead of 
finishing work on a defense bill may have the effect of forcing the GOP to wait even 
longer before claiming a victory that big business has sought for years. 

The Senate will vote Tuesday on whether to act immediately on the bill to move more 
class-action suits from state to federal courts instead of continuing work on the 
Defense Department's $422 billion authorization bill. That was the pending business 
when the Senate recessed for its holiday break on May 21. 
Several Democrats have promised to join with the GOP to give Republicans the 60 votes 
they need to move the class-action bill to passage. But those same Democrats are 
expected to refuse to vote to abandon the defense legislation to do it. 
They believe in class-action reform a lot, but they are not going to vote to skip 
over the defense bill, said Assistant Democratic leader Harry Reid, D-Nev. We believe 
we should finish the defense bill and then go to class action. 
Frist wanted to put the defense bill off because Democrats are refusing to agree to a 
limit on amendments, and Frist wants extra time to negotiate. Moving to class action 
would give Frist that time. 
The class-action bill does have strong bipartisan support, and we would like to 
finish that bill in a reasonable period of time, Frist said. 
The GOP bill would move more class-action lawsuits - where one person or a small group 
represents the interests of an entire class of people in court - out of state courts 
where juries are often more generous to plaintiffs, and into federal courts where 
awards typically are smaller. 
Senate Republicans and the corporate community, for whom curbing class-action lawsuits 
is a major priority, say businesses are drowning in frivolous lawsuits while trial 
lawyers profit handsomely by sometimes just threatening legal action. 
We are extremely pleased that after six years the United States Senate will finally 
have the opportunity to debate and vote on legislation to fix the country's broken 
state court class-action system, said Stanton Anderson, executive vice president of 
the U.S. Chamber of Commerce (news - web sites)., who called the bill moderate and 
reasonable. 
But many Senate Democrats and other opponents say the legislation only helps 
businesses escape judgments for wrongdoing. Huge damage awards are needed to ensure 
corporations play by the rules, they say. 
Federal judges, opponents say, will either throw many of the cases out or be less 
likely to issue multimillion-dollar judgments against corporations if the bill is 
passed. 
The Senate proposal is designed to kill the use of class-action lawsuits, which have 
resulted in decisions that not only provide refunds to consumers and others injured by 
corporate wrongdoing, but also require changes to business practices that have cheated 
consumers, workers and even local and state governments, said a statement from 
USAction, a liberal, pro-consumer activist group. 
GOP senators fell one vote short of achieving a filibuster-proof, 60-vote majority in 
October. But now several Democrats, including Christopher Dodd of Connecticut and 
Charles Schumer of New York, have agreed to support the legislation. 
Democrats feared some of their state constituents would lose their right to sue in 
their own courts. Under the deal, Democrats get additional exceptions in the bill that 
they say will preserve class-action lawsuits that belong in state court.

To Alabama coach Mark Gottfried, it might as well be the Los Angeles Lakers or nearby 
Central High School.

Quite simply, too much is wrong and too little is right these days for the Crimson 
Tide.

We have to figure out ourselves, Gottfried said Monday, as well as figure out 
Florida.

Sure, Alabama still has a sparkling RPI - checking in this week at No. 19 against the 
nation's third-toughest schedule despite the ugly loss Saturday at Ole Miss. Sure, the 
premature NCAA Tournament projections all have the Tide on their brackets.

But that's the past and the future.

The problems are in the present.

Leading scorer Earnest Shelton will miss his second straight game with strained knee 
ligaments. Starting center Jermareo Davidson went down against Ole Miss with a knee 
injury of his own, though he's expected to play against the Gators.

Then there's Kennedy Winston - who is the Tide's leading scorer in Shelton's absence. 
But his left knee, which required surgery in September to repair torn cartilage, was 
being temperamental Monday.

He woke up (Monday) morning and it looked like a grapefruit down there, Gottfried 
said of the swelling in the knee.

So with this unsettling backdrop, Alabama (11-5, 3-2 Southeastern Conference) will try 
to maintain its 11-game winning streak at Coleman Coliseum.

Obviously, Gottfried said, we've got to play a great game to have a chance to upset 
them. We're banged up and that's not where you want to be going into a game like this.

Davidson will play but his knee won't be 100 percent, Gottfried said. The same goes 
for Winston, who has battled soreness all season.

The wounded Tide must recover to face the Gators, who spent a week at No. 1 earlier 
this season and are 12-4 against the nation's toughest schedule. Florida snapped a 
two-game losing streak with Saturday's 68-52 win over Auburn.

But the Gators are just 1-2 on their opponents' home floor this season, losing at 
Louisville and Vanderbilt and winning at South Carolina.

We've been a pretty good road team the last several years, coach Billy Donovan said. 
But maybe we're starting over on the road from the standpoint of having a lot of 
young guys trying to figure out how to play on the road.

Indeed, the Gators (12-4, 3-2) started four sophomores and a junior against Auburn. 
But four starters - forwards David Lee and Christian Drejer and guards Anthony 
Roberson and Matt Walsh - are scoring in double figures.

And while all four are capable of carrying the Gators themselves, Gottfried is 
particularly wary of Roberson - the sharpshooting point guard who has made 44 percent 
of his 3-pointers this season.

I'm not sure there are a whole lot of guards better than him, Gottfried said. He 
shoots it quickly and effectively. He's a big-time basketball player.

 with.  This staff is getting where it looks like the old Ray Perkins

 For what ever reasons, it doesn't seem like Mike is making the best 
 decisions.  Maybe it will work out.  I sure hope it does but I'm becoming 
 less optimistic.  I guess we will know by this fall.

I don't have a problem with the interview. The fact that he
had been at auburn, then come to Bama, and had been cheerleader
at both is just the kind of side line fluff that ESPN loves to
look for.

I most definitely have a problem with him standing on the Bama side
line, during the Iron Bowl, wearing Crimson and White, and announcing
to the world that his heart is still and will always be in auburn. If
that is the case, then his ass needs to join his heart.

he made statements back in the summer that indicated he would _probably_ 
opt for the NFL after this season. I've felt all along that he was a

A preseason All-American who figures to have a future in the NFL, Smiley
said that the broken leg sustained last Saturday by close friend and

NFL prospect Wesley Britt has affected Smiley's thinking about turning

Smiley pointed to the fact that a serious injury such as Britt's could
jeopardize his chances in the NFL before he draws his first paycheck.

I can't say that hasn't crossed my mind, Smiley said Tuesday. That's
definitely been something to think about. This season hasn't gone the way

would like it to go, team-wise. You don't want to leave on a note like
 
 that.
 
But when you see one of your friends get hurt, that could definitely hurt
your stock (in the NFL draft).

It did cross my mind. Why don't I get paid and have a chance of making
 
 some
 
money and have this happen to me (rather) than to stay here and get hurt
 
 and
 
not make any? But that's one of the things we'll have to approach at the
 
 end
 
of the season.

The injury to Britt was particularly difficult for Smiley. The two have
lined up side-by-side on the offensive line since they were freshmen.

For the next few snaps after Wes got hurt until something that took my
thought off that, you play not to get hurt, Smiley said. You see

like that and it's rough.

He breaks both bones in his (lower) leg and the bone is almost sticking
 
 out
 
of the skin and you see your friend laying there . . . I'm only a foot
 
 away

sentiments, but thse kids all want to play in the league.  Have you ever talked with 
any of them?

BTW, Fran is getting roughly the same money at A  M that we were offering, so his 
leaving was not about money.  It was more about sanctions, and the fact tha the'll 
probably own Mack Brown in about 2 years.

him with Danny Martz full time?   There isn't a single
person (except for maybe SW or BC) who can even think for one minute that
they are 'vital' while admiring the season thus far.  What world are you in?  Smiley 
are Britt are BY FAR our best linemen.  Take those two out, and see how the running 
game explodes.

He's gonna lay down and go thru the

For the record, most people have him in the 3rd to 5th round, so if he did make the

I don't understand why people are getting upset about this.  If you asked
everyone on the team, they would more than likely say teh same thing (if
they were honest).  JS is a vital cog in our offense, and when he isn't in
the lineup it is very noticeable.  To say we would be OK w/o him is
laughable.  He will continue to play hard, but evaluate his options at
year's end, like they ALL should do (who here wouldn't do the same?).

He was a very good OL coach, IMO, but we were running a different system, regarless of 
what Joel says.  Different schemes, reads, etc.  This scheme is more of a pro type 
scheme with straight ahead blocking, whereas Fran's system was more of a finesse 
system.  Folks, if you think it's bad now, just wain until Smiley and Britt are gone.  
Have you looked at the depth chart lately?

 couldn't sleep last night it made me so sick. Just
 DAMN if it's true.   And no, I am not flaming anyone
 - I will continue to support this team and Coach!!!

While I have no doubt what you were told, this whole thing reeks of bullshit.  When we 
fired XCMD, all of the insiders had the short list of candidates.  They were wrong.  
When anything goes wrong with the team, we have the insiders who go out into a group 
of people and start spewing confidential, inside information.  They are all wrong 
(hi tider-insiders!)  

What I have learned in the past is that the people with true, inside information 
don't talk about it.  That's how they stay on the inside.

 complimentary. Lee Baker has been a staunch defender of Marsh, for

We probably brought 5,000 fans.  That's about normal.  I thought it would 
be bigger, but it was still about normal.  It's just that Bama split us up 
and put part of us in the lower deck and part of us in the upper deck.  I 
think that's what made it look like less.

The transfer from Miami, Marc Guillon, is easily the 2nd best QB on our roster right 
now.  If Spencer cannot make all the throws that Brodie can, then it would definitely 
hamper our ability to move the ball.  I understand your relationship with Spencer's 
family, and respect that, but do you not feel the same would happen if Spencer was in 
the game 9as it realtes to your last sentence)

I was there, and I'll tell you you're incorrect.

 basically overall we looked like shit.

WRONG. Considering how banged-up we were, coming off an emotional game, I
thought we looked business-like and pretty good. We had more than 400 yards
total offense, for God's sake, and held them to less than 50 yards rushing.
And WON THE DAMNED GAME by 10 points.

 The officiating sucked.

SEC officiating is never good, but all fans at all levels think the refs are
out to get them.

 Brodie is very confused.

wrong, wrong, wrong...Brodie is a SOPHMORE quarterback learning a new
offense who occasionally makes a senior-, even NFL-type throw. But mostly,
he looks like a sophomore quarterback learning a new offense.

 We never should have taken a knee at the end.

Wrong.

 Another major error was Clint Johnson was wide ass open when Brodie was
scrambling  he threw it to the end zone.

Too bad Brodie's not perfect. It's not always as easy as it looks.

 Another thing that bothered me is Brodie sliding after running.

Didn't bother me a damn bit. Brodie's not Tyler Watts--he's not that type of
QB, and he's not as big. Folks, we are a Brodie injury away from being
Vandy...trust me, we do NOT want to hand the reins over to #13 for the rest
of the year. Brodie had a hurt shoulder from last week's game...he's plenty
tough, has nothing to prove, and needs to stay healthy. He's probably the
No. 1 player we can LEAST afford to lose.

 We took 2 time out's because we couldn't get the plays in.  IMO.

Right. Shula said as much right after the game. Too bad Shula's not perfect,
either. You might look at the fact that we, overall, look well-organized and
penalty-free, and last night was the first night we've had that problem.

 The people around me sucked.

I'm sure they thought the same thing.

 I don't believe in outcome based nothing  I sure as hell don't believe in
good effort when there was none.

That's a ridiculous comment. If you think the team didn't give a good
effort, then you weren't watching the same game I was. And if you don't
think a 10-point SEC win was a good outcome, then I can't help you.

 I was an outcast for pointing out the facts...

 Alabama was decked by their first probation and Bowden had just reeled
 off an incredible three-year start at Auburn. Alabama was laying down in
 the coffin ready to be buried, and Bowden managed to choke his way
 through three subsequentially horrible seasons and simultaneously
 breathe life right back into a flat-lined Alabama. 
 
 Next, Alabama desperately attempted suicide over the monumental Mike
 Dubose debacle and ceremoniously laid its head on the chopping block.
 All Tubby had to do was beat an unranked Alabama in Auburn in 2001 and
 they would have been cooked and done. But, oops! Eveybody stand clear
 while Tubby works the defibrillator on Alabama. 
 
 I realize that Auburn and Alabama haven't played yet, but I work in
 Tuscaloosa. I know what I'm seeing all around me. First there's
 probation, then there's Coach Fran's departure, then there's Price's
 strippers, then there's Shula's racial issue. Could Alabama have been
 any deeper in the hole in August? Could nailing the coffin shut have
 been any easier? I can personally attest to the words of Alabama fans
 all around me every day at work, and their Herculean rejuvenation of
 spirit is based at least half due to Auburn's embarrasing collapse. 
 
 Somehow, without even playing Alabama yet this season, Tuberville has
 managed to give them the life they so desperately needed.

FWIW, I don't have a problem with this change. I always sorta cringed 
when we'd do the cheer BEFORE the fscking game even kicked off. I'm of 
the opinion that it shows much arrogance on our behalf. Now when the 
game has finished and Bama has kicked their ass, then we can let'em have 
it!! It is a great cheer but should only be used at the appropriate 
time. I'm cool with it.

of how they had Alabama on the ropes. Let them know how young they are and
how far they've come.
Pat them on their backs. Chuck them on their shoulders. Tousle the hair on
their scrappy little heads.
Then duck.
And be careful you don't lose an arm.
The Bulls don't want to hear it, okay? Save the comments about how close
they came and how cuddly they looked. Stop the praise and change the
perception. USF doesn't want to be anyone's cute little brother. It doesn't
want to be Spartacus.
The Bulls lost, okay?
And if you want to make them happy, you can be as ticked off about it as
they were.
Did you see that game get away? Were you there when Alabama went roaring
past? Do you have any idea what happened to their poise, their fire and
their 10-point lead?
One moment USF was ahead 17-7 and in charge of the day and the next, they
were on their heels, confounded and dazed, trying to figure out their last
mistake while making their next one. The change was as quick as flicking off
a light switch.
Alabama won 40-17 and it was only the mercy of Mike Shula, old Coach Boo
Boo, that kept it from being worse.
So go on. Let it annoy you. Talk about how the team blew a chance at
victory. Talk about what it let slip away. Get mad.
USF coach Jim Leavitt certainly did. His post-game review was, well, loud.
Also long. And harsh and passionate and pointed.
I brought the heat, he said, a little sheepishly. I let my emotions get
the best of me.
In summation, Leavitt pointed out that, gee, it would have been nice to play
two halves instead of one and, golly, he prefers winning to losing and, by
gum, he sure would like to see a little better coaching and a little better
playing. To be accurate, Leavitt put it a little stronger.
I'd have been disappointed in him if he hadn't been mad, quarterback
Ronnie Banks said. We let him down. I let him down.
I wouldn't want a coach who didn't get mad at us at a time like this,
center Alex Herron said. That's why I think (Leavitt) is one of the best
coaches out there. There is no such thing as being happy about coming close.
That's not our motto.
There is a tendency to treat a relatively new program as the Little Engine
that Could. After all, Alabama has a 102-year head start on USF, and it has
the 12 national championships and statues of Bear Bryant. And, despite its
recent scrimmages with the NCAA, Alabama still recruits off the top shelf.
Given all that, the snapshot of USF leading by 10 in the first half will be
enough for some fans.
Certainly, it was a surprising picture. After 28 minutes of play, the Bulls
completely outplayed Alabama. They led 17-7, and Alabama's points had come
on a tipped pass that was intercepted and returned for a touchdown. At the
time, two things seemed clear: USF had a legitimate shot to win, and for a
coach, Alabama had hired Frank Sinatra Jr.
If USF wins this, the thought was at halftime, Shula wouldn't be allowed to
live and Leavitt, a coach Alabama had flirted with, wouldn't be allowed to
leave. You could almost sense the Tide crowd re-assessing fired coach Mike
Price. Hey, what's a little smut among friends?
Then it changed. One minute, USF was the roadrunner, and the next it was the
coyote, standing in midair after running off the cliff, eyes wide in that
moment before the fall.
Alabama hit a long pass. USF didn't cover a slant. USF fumbled a kickoff. In
a 69-second flurry, the Tide was tied.
Just like that, the fire was gone from the Bulls. USF was on its heels,
absorbing instead of attacking, chasing instead of challenging. Alabama
threw where it wanted to - Hey, who told Shula about the pass? Wait until
Trent Dilfer hears about this. - and eventually, its huge offensive line
wore down the Bulls. The Tide kept the ball the last 61/2 minutes without
throwing a pass.
Let's face it. If USF wants to be treated as a big-time program, then, yes,
it deserves some criticism for that second half. It mailed it in. It didn't
compete.
We should have won by 14 points, easily, linebacker Maurice Jones said.
We let it get away. They aren't that good.
How good is South Florida? At this point, we don't know. As Leavitt says,
there is a lot of work to be done.
At this point, the Bulls have to become stronger mentally, more composed,
more resilient. They have to do a better job with pass coverage and with the
pass rush. They have to run the ball better. They

much for him to handle being around Chief every day. Man this guy needs our
thoughts and prayers.

Dude, with this bunch you just never know. Several times I've seen 
disparaging remarks whenever the name TI is mentioned. I just don't get 
it. IMO it's an excellent message board and source for Crimson Tide 
sports information _and_ is highly respected. If it's not sarcasm, then 
it must be the $36 TI charges to read the inside information. Someone 
explain to my dumb ass what the problem is if someone wants to do that. 
I'm not flaming anyone, just seeking a better understanding.

I'm all for exposing people, BUT the U of A (which is my main concern here) will not 
be helped by this at all.  We will not get anything back.  Nothing.  First, we are not 
a plaintiff here.  Second, Marsh and Robins are irrelevant going forward, because 
Marie is no longer in compliance, and Marsh's tenure as Faculty Rep is almost up.  So 
what if Cully is exposed.  How does that help UA?  It doesn't.  IMO, this will only 
bring further scrutiny of the U of A.  Cottrell nor Ivy Williams cares about the U of 
A.  They are out for themselves.  They are simply trying to gain public support from 
Al fans in a PR charade.  JMO.
