Control Lists are supported from Solaris 2.6+. I am running Solaris 2.8

A few things you may try.
First, make sure your ACL utilities and samba are compiled against the equivalent version of the libaries; make sure your versions line up as best as possible. Second, make sure you've mounted the filesystem with the acl option set
That must be it, I didn't see that mentioned anywhere.
