Re: [sustainable_tompkins-l] Proposition #3 on this November's ballot: the Public Safety and Land Account

2017-10-20 Thread Anna Kelles
Hi Scott,

The 250 acres is not a parcel of land per se but rather focused on the
strips of land on both sides of all of the roads in the parks. If a
municipality does want to use land it either needs to buy it at market rate
or donate an equivalent amount of land to become part of the park land. The
specifications however for what qualifies is very narrow and explicit. I
just sent this addition to the Fall Creek Listserv but I wanted to add it
here as well, it is a recent message from Bill, one of the authors, "The
language of both the Amendment and the Implementing Legislation is both
narrow and explicit, enough to clearly spell out that pipelines are not
being authorized. Plus, while specific language doesn't mention retail, the
narrow authorization of the Amendment precludes any realistic retail use."

I hope this helps!
Anna

Please come and take some black walnuts that are in bags and boxes outside our
entrance, in the parking lot behind 615 Willow Avenue in Ithaca. Take them all!

You may also take some canna lily tubers to replant in the spring, from a
wheelbarrow located in the same area.

[sustainable_tompkins-l] Proposition #3

2017-10-20 Thread Susan Multer
Thanks much, Anna, for your summary and the link. Everything mentioned
is good and should be allowed without 3-year delays. My question is, how
do we know for sure that passage COULD NOT also allow oil or gas
pipelines or concession stands to sell bottled water, etc.? I didn't
used to be skeptical like this, but the political climate we now live in
warrants asking for assurance that such things could not happen.

Thanks, Susan

Hello neighbors, colleagues, and friends,

As most of you probably know at this point, the ballot on November 7th
will have several propositions on the back to vote on. One of them is
Proposition #3 for the Public Safety and Land Account.  At a recent
conference I met the author of the proposed amendment to the
constitution Bill Farber, chair of the Board of Supervisors for
Hamilton County.  He has spent the last few years getting bipartisan
support in Albany for this bill, unique for a bill focused on the
environment.

He described to me the impetus for the proposition. Throughout the
Adirondacks and Catskills, although much of the land is parkland,
there are roads crisscrossing through and many are local county roads.
Maintenance of the roads is governed by the counties but this is made
difficult because the park land is designated up to a few feet away
from the roads. Every time a county wants to adjust a sharp turn, add
a bike lane, add culverts, perform erosion mitigation in the ditches
they have to obtain a state constitutional amendment. For some
counties the process is so time consuming and costly they are forced
to defer the work, which can be both a public health and environmental
detriment. This proposal would allow local counties in the Adirondacks
and Catskills to maintain the roads and land adjacent to the roads
without needing a state constitutional amendment.

This is a summary of the conversation I had with the author but if you
