I want that it serve the /index.jsp file
when a page is not found
but as I described (see below)
I need a 404 status code in the http response header.

If you don't want tomcat to serve your /index.jsp when 404 is encountered,
just remove the config from your web.xml.
Is this what you are asking? Not sure I got your question right.
