After much pain found out that the tomcat deamon will die when the parent shell is using sh.
In bried user tomcat has /bin/sh for a login shell and executes catalina.sh or startup.sh from shell prompt . The j2se daemon runs fine and is owned by parent process 1 until the tomcat user logs out and then the daemon dies.
