It was fixed in maverick and later. If you want 3 in your PPA, take my
maverick packaging, update it to 3.0, and backport it to lucid, for your
PPA.
It's not too late to get 3 into oneiric, if it's needed for anything,
but we'd need to move fast.

I'm getting the same problem (see

download Cg 2.1 - how do we obtain Cg 3.0 (on that note, I note apt-get
for nvidia-cg-toolkit also only downloads v2.1 on Ubuntu,
Launchpad bug auto-closing is currently broken. This bug was fixed in
the following upload:
