9.10 is not a supported Ubuntu version any more. syslog-ng in recent Ubuntu releases is not affected by this problem. If you want to use the latest syslog-ng release (3.3), please use packages from http://asylum.madhouse-project.org/projects/debian/ which fixes some bugs even for the syslog-ng
