The bug is partly fixed in lp:~3v1n0/unity/panelmenu-fixes basically this bug 
contains two different issues:
 
1) The compiz grid fullscreen effect shouldn't not be shown when dragging a 
maximized window from the panel
2) A fullscreen window get redecorated

1) is currently fixed in my branch using a workaround (since that mostly 
depends on compiz)
2) The fix is in progress, but is mostly caused by a race condition of X.
