My first post:
update-grub was not updating my menu.lst file. To test, I created an
empty menu.lst file and ran update- grub.
1. when upgrading from 9.04 - 9.10 it doesn't changed my menu.lst.
2. trying to run update-grub the output says that it found all kernels
(including new from 9.10) and

This IS AN ISSUE. After upgrading from 9.04 - 9.10 it will not upgrademy
menu.lst, even if I try to do sudo update-grub.
Sorry, but when this can not update one of the most important files to keep the
user system working, it IS AN ISSUE.

The bug you reported is if I create an empty menu.lst, it doesn't get

Users who are doing a normal upgrade from 9.04 to 9.10 don't have an
empty menu.lst; the only way to get an empty menu.lst is to create one
by hand.
Are there more details you can provide regarding the problem you had
If, instead of creating an empty menu.lst file you /remove/ the menu.lst
and then run update-grub, does it work correctly?

Thanks for confirming. Closing this as 'wonfix'; I can't see any reason
to create an empty menu.lst, so I don't expect this to ever get
developer attention given that we're in the process of transitioning to
grub2.
