I personally feel that showing the menu when hovering over the panel's window controls an attractive behaviour. It shows new users, when they go to interact with a window, that there is a menubar hidden in the top-panel that shows when they hover over it. I (personally) find the switching to the menu when hovering to be distracting too. I feel that it should be shown the entire time, except when on the desktop with no programs open. In that case, it should work by hovering like it does now.
