Moving the bug to dpkg as lxc isn't doing anything weird that'd explain this.
Replacing a file currently in use is perfectly possible on Linux and shouldn't 
cause that error.

it's not up to dpkg to 
  ensure the world is writable.

wonky, or some strange 
  kernel issue, perhaps relating to repeated suspends with 
active containers?
