I love it!  Maybe instead of ranting about our peeves we should actually 
vlog something on our peeves... Not just a I'm sitting in front of the 
camera bitching for 3 minutes (not that that can't be hilarious) but maybe 
something very creative and funny about how our pet peeves affect us and our 
lives... Sorry I'm babbling... back to my corner.

Hey,I'm back from SXSW. The Darknets panel was a good and touched on some of the copyright issues. Personally, I think a system where something like The Grey Album is illegal, doesn't work. Now the MPAA (they had a representative on the panel) and the RIAA still look at this as theft. As long as that's the case, things are not going to change. And they certainly won't listen to me as an individual on the issue. But if people in aggregate willfully disregard these laws where they're just plain stupid, I think, they'll be forced to come up with some sort of solution. Just as background - I come at this as an artist who very much respects people's right to get paid for their work and on the other hand I also believe that by contributing to and participating in culture (popular and otherwise) you give up total control over your work. A few years ago I made a short film about my brother and I playing Star Trek as kids (here's the link all you fellow Star Trek nerds: 
http://www.michaelverdi.com/video/mjplaystartrek.mov ). I wrote to Paramount asking for the right to use the tricorder and transporter sounds. What I got back from them was a letter explaining how I could not use (with no option to license for a fee) those sounds along with the words Spock, Enterprise or Phaser. I just think that's complete bullshit. We didn't play Star Voyages as kids or run around with Quadcorders or something. It was Star Trek. Those are my memories and this film is my way of remembering. I don't really give a shit if you've trademarked that stuff - it's part of the culture and they've benefited from that by both ripping lots of others off in the ideas behind it and in the billions of dollars they've made because of it.

Makes perfect sense to me. If Leonard Cohen wants to control how his

 Similarly, videobloggers aren't going to instantly get sued for using
 copywritten music/content... they will get a cease and desist order
 and if they do not comply, they will then be fined or get a court order.

I think it is incorrect to say 'copywritten' as a work you create has 
your copyright assigned to it. How you choose that work to be used is 
different from this. The music I can get from Magnatune still has a 
copyright held by the artist, but the *license* allows me to use it in 
certain ways.

 That said, stop worrying so much about it.  As long as we all know the
 consequences, we can remove certain files from the Internet if they
 are problematic.  I mean, it's not like you can just call up U2 and
 ask if you can use their music!

Well, some of us are big believers in things like Creative Commons, 
which allow an artist to easily specify how their work can be used. U2 
is a lost cause, they don't even have the rights to their music. (Look 
up Negativland for more on that one!) The hope is that from this point 
on, artists will realize they *can* have control of their art, and how 
it is used, and in 10 years, or 20, or whatever, the world of what you 
can legally/safely use is quite different. It's already happening, but 
we can help make it happen.

 Personally, I wouldn't use copyrighted material if I were making money
 off of it, but if it's all in good fun, I think it's fair to use it. 
 (I don't see many people complaining about the use of the Brokeback
 Mountain song with all the homages like Brokeback to the Future, etc.!)

Again, it *is* ok to use copyrighted material, as long as you have the 
rights to do so. Getting those right can sometimes prove difficult. (See 
above.) Of course there is the issue of what is commercial as well. 
Are you making money from ads on your site? Affiliate programs? PayPal 
donation links? Who decides what making money consists of? (The courts?)

As for complaining about people using the music from Brokeback mountain 
without permission (unless it's fair use ala parody, etc.)  just point 
me at them, and I'll complain! ;)

The reason I think all of this stuff is important is that I want to see 
videoblogging grow and grow, and pretty much explode, and I want to see 
it done without violating the rights of artists. I want to see it done 
in a way that steps around all that is wrong with the RIAA and MPAA and 
those that would see us crushed beneath their wheels

(Whew, rant mode off...)

I'm not sure it works that way in the case of the show in question.  A 
certain amount of fair use is allowed in these areas.  For example, it's 
my understanding that a person could write a book dissecting the lyrics of 
Leonard Cohen without ol' Lenny being able to stand in the way.  The 
question of derivative work and fair use, as I understand it, is that if 
the derivative work is *about* the original, rather than a *restatement* 
of the original, then it's allowed.  Whether a top 100 list is about 
could be in question though.

And, I reiterate: the music currently available under Creative Commons does not suit every need. I did look once for Indian music to use in my trailer, and did not find it. Someone in this thread said something about using popular music being easy. Damn right, and that's part of the reason I do it. I don't get paid for videoblogging, already rarely have time for shooting, editing, processing and posting, and don't have more hours to spend identifying the right music with the right license.
I would gladly pay what it's worth for the right to use copyrighted music. But it needs to be easy. Many people downloaded music illegally because it was by far the easiest way to get music. Now that Apple has made it easy to get music legitimately, they've sold 1 billion tracks. I suspect that if someone comes up with an easy way for creative people to pay a reasonable fee for use, many/most will do it. Someday someone will build a business around this, though right now it's probably not worth it because the market of creators is much smaller than the market of listeners.

how to questions give good advice that won't get them into legal hot 
water, or at least *warns* them about what might get them in legal hot 
water.

Maybe if the folks who use things without permissions put a Used 
without permission disclaimer on the stuff they create.

Most vloggers can't budget anything other than creative commons works
or works from folks who are allowing for free (negotiated on a
grassroots basis).

But, if  you have money to spend there are plenty of libraries (video,
audion, photo, etc) online to accomodate your needs.

there's no incentive to test this in the courts,
because major copyright owners - the ones likely to be
involved in test cases - are inherently likely to win,
given a) the resources they can bring to the table to
fight, and b) the fact that the laws are written
poorly (in other words, massively in their favor) in
the first place.  when congress can just wave its
magic wand and extend copyright indefinitely, who
cares what some minor court has to say about anything.

process is *not* hidden, that it's exposed to all

which seems to me to be since there isn't enough good
CC music in the world, the law should let me take
whatever i want from whomever i want, and that is
conceptually problematic.  CC is a nascent movement;
of course it doesn't suit every need right now.  but
the likelihood that CC could grow as a popular
movement into the sort of thing that suits your/our
needs is much greater in my opinion than the
likelihood that the united states congress is going to
suddenly have an a-ha moment, ignore entertainment
industry lobbying groups, and magically stop
repressing remix culture.

I love capturing screens. i do it all the time and have always considered it a sort of digital art. the pixelation noise and flickering etc it can really add some interesting layers to an otherwise typical visual experience. I have many clips to this effect. I should post them. Some are actually quite funny because of distorted heads when you angle the lense against a screen. 
If i was doing a tutorial screencast, i would use proper screencasting software. but for fun and sake of art its all good.then again, i'm was a pixelvision kid. sull

I like the concept of a Copyrighted Material  limited Use Fee I know I'm 
willing to pay to download music from one site or another for a nominal fee. 
If I like the CD I'm still gonna go out and buy it at Sam Goody or Tower so 
I can get the cool cover art and lyrics, photos etc.

If I'm willing to do that then It stands to reason that I'd be willing to 
pay a yearly subscription fee of a reasonable amount to a site that would 
allow limited use of material by more famous musicians, film-makers, etc. 
How realistic is it that the Big Guys would ever do this?  Not likely at 
all unles the faceless masses bring it to somebody's attentioncome to 
think of it... do we have a Vlog Lobby?

I happen to believe that it's technically wrong to use others work
without permission. But then again on the great grand list of things
that one can do wrong that's somewhere near the bottom. White lies are
technically wrong too. Obviously there is some risk in getting a nasty
letter or even a law suit from doing it. I just think it should be up
to the creator of the video in question just how much risk they are
willing to take on. If someone wants to use someone else's music it's
between the videomaker and the entity that owns the rights to the music. 

What I would encourage those of you to do who want to use music with
permission is to forge relationships with local musicians and just ask
if you can use their music. Most of the time they will say yeah.
That's all need to do, is ask permission. You don't need written
contracts, all you need is a verbal YES. Especially if you are just
unknowns and friends just trying to help each other out. Besides this
is a powerful medium, why not use it to promote some people in your
local area that deserve to get some exposure? That's basically what my
vlog is all about, so I'm sorta in this mindset already. 

And while you're out making friends with other people who are into
other kinds of creative endeavors you can help spread the word about
Creative Commons.

  ask if you can use their music!
 
 Well, some of us are big believers in things like Creative Commons, 
 which allow an artist to easily specify how their work can be used. U2 
 is a lost cause, they don't even have the rights to their music. (Look 
 up Negativland for more on that one!) The hope is that from this point 
 on, artists will realize they *can* have control of their art, and how 
 it is used, and in 10 years, or 20, or whatever, the world of what you 
 can legally/safely use is quite different. It's already happening, but 
 we can help make it happen.
 
  Personally, I wouldn't use copyrighted material if I were making money
  off of it, but if it's all in good fun, I think it's fair to use it. 
  (I don't see many people complaining about the use of the Brokeback
  Mountain song with all the homages like Brokeback to the Future,
etc.!)
 
 Again, it *is* ok to use copyrighted material, as long as you have
the 
 rights to do so. Getting those right can sometimes prove difficult.

 above.) Of course there is the issue of what is commercial as well. 
 Are you making money from ads on your site? Affiliate programs? PayPal 
 donation links? Who decides what making money consists of? (The
courts?)
 
 As for complaining about people using the music from Brokeback mountain 
 without permission (unless it's fair use ala parody, etc.)  just
point 
 me at them, and I'll complain! ;)
 
 The reason I think all of this stuff is important is that I want to see 
 videoblogging grow and grow, and pretty much explode, and I want to see 
 it done without violating the rights of artists. I want to see it done 
 in a way that steps around all that is wrong with the RIAA and MPAA and 
 those that would see us crushed beneath their wheels

Oh, to be fair I have to admit that in my first vlog, Branding Power
the script is based LARGELY on a parable by BuildingBrands.com. I do
give him full credit, and I did change it a little.  So, perhaps I'm
violating my own rule, cause I didn't contact him first? 

I think one of the other reasons I don't like when folks use hollywood
footage and famous bands is because it takes the 'grassroots' out of
vlogging, and it kind of seems like 'cheating' to me. Just my humble
opinon.

I've seen the group beat this poor ex-horse so many timesThis is one of 
those topics that is so political that it can never be solved so all I'll 
say is:

Every creative thing that has been done by anyone... has been done by 
someone else before to greater or lesser extent.  Our World Religions, our 
Cultural Customs, the sociological makeup of World Society, our Music, our 
written works, our art. All of it is built upon the utilization of previous 
generations efforts. We all tap into the same creative universal brain soup.

  Should a creator receive credit for what he does? Absolutely. Should he 
reap the rewards of his creation?  Of course.   Should we use other people's 
work without crediting it? Hell no, nor should we reap a financial reward 
from it. Should we have to pay some ungodly fee for the use of said material 
in a vlog that may have a circulation of 100 or less people?  I think not.  
Should we have to pay some kind of fee at all?  H a better question 
is... if we Had no choice but to pay for it... would we use it? Then comes 
our moment  of truth as to whether it is necessary... or... easy.

Are we ever going to agree on this?  Goodness no... if we did we'd have 
nothing to keep our blood warm during the cold winter months.  Debate is 
good for the soul.

The true peeve comes when people lose their ability to be civil to each 
other in the process.

There is never a reason to be unkind to each other if we do not allow 
ourselves to be emotionally invested in the matter open for debate.

Okay.. I'm done now... commencing to shutting up.

I still don't see that if you use a soundtrack  hat someone else has
performed, because you are not making money  from it, or shouldn't be,
then a piece of music is like an advert for  the copyright owner.  

Paul, I understand your thinking, and it seems logical on the surface.
However companies/bands/whatever place a ton of effort into their
talent, their creative products, their brands and their marketing.
They do not want to be placed in things that may not be compatible
with their brand plan. Or, in the case of very large/successful
entities, they do not want to be placed in anything that is not part
of their brand/marketing strategy. 

For example, we've taken great care to brand DivaDirectories with
strong female images. If someone were to use elements of our brand in
a vlogcast about biknin babes or 'girls gone wild', I would be
extremely offended, would see it as damaging to our brand, and you can
be sure that they would hear from a not-so-happy Monique. 

The bottom line is that I feel that folks should have the right to
control their own works. If you email them and they grant you
permission, then go for it. 

Also, I feel a bit cheated when I click on a vlogcast and what I see
is footage from a large film. I want to see ORIGINAL stuff from the
vlogger.

Finally, vlogs may be small now. BUT eventually vlogging and certain
vlogs will get big traffic. So, we have to deal with this issue now.

But, that is just my opinion. 

Anyway, this thread isn't supposed to be about only copyright. It's
about vlogging mistakes. So, does anyone have any others.

Thanks Paul, I agree with you too.  In the media world, there IS such
a thing as a cease and desist.  I was talking with someone from the
CBC the other day (more about this subject at a later date) and he
told me about how someone was compiling a Top 100 songs list for a
major network he said that they got a cease and desist order from
Leonard Cohen (or some boring musician like that) and they couldn't
use him in the FLATTERING Top 100 show they were making.

Similarly, videobloggers aren't going to instantly get sued for using
copywritten music/content... they will get a cease and desist order
and if they do not comply, they will then be fined or get a court order.

That said, stop worrying so much about it.  As long as we all know the
consequences, we can remove certain files from the Internet if they
are problematic.  I mean, it's not like you can just call up U2 and
ask if you can use their music!

Personally, I wouldn't use copyrighted material if I were making money
off of it, but if it's all in good fun, I think it's fair to use it. 
(I don't see many people complaining about the use of the Brokeback
Mountain song with all the homages like Brokeback to the Future, etc.!)

I use Magnatune and I couldnt be happier. I emailed them a while back
regarding using their music and they sent back a credit card number
for me to use whenever I wanted to purchase music to add to my
videos at no charge to me.

The stipulation is that I promote their artists in my videos. Not a
problem at all. I get great music and their artists get promoted. It's
a win win situation.

With running an internet radio station in the past and having had my
fair share of battles with the RIAA, that's not a road I want to go
down any time soon.

No no, I wasn't referring to this exact thread at all :-} I've seen everyone 
actually being pretty laid back.  I've just noted at different times and on 
different threads some snippy-ness...but again... the written word can be a 
very difficult medium to work with and it is so easy to misconstrue a 
meaning in the words that may or may not actually be there.  On the whole 
I've found my fellow vloggers to be a fairly accepting and helpful bunch.

and the courts see it.

If you want to be the first to get caught just use some material for 
which you have no rights to, and we'll be glad to alert the owners of 
such material at your request.

search for.  I've visited each of the sites listed below (and a few
others) and none of them are efficent.

PodShow.com is probably the best, but the searchability is still
brutal.  The effort it takes to find a single, halfway decent song is
not worth my time.

Until then, I'm off to see what is new on AllofMP3.com

Kitka,First of all, as far as I'm concerned, just film the screen ... not a pet peeve of mine ... you make great videos just the way they are.However, if the spirit moves you and you want to do official screen capture, that's, at least, less of a hassle than filming the screen, camtasia is great ...
