Are you pressing the control on the mic to invoke Siri? As I understand it, the
mic used depends on whether you press the home button or the button on the pods.

I am using the play button on the remote in the usual way and speaking into
the remote in the normal way but no luck. Funnily enough whether I use the
remote or the home button to invoke Siri, speaking near the phone makes it
recognise me which is what makes me think it's using the phone
This is a funny question, and probably quite redundant, but are your phones
plugged in all the way?
