Shane, This happens because you must have Automatic Downloading turned on for apps on your iPhone. You can turn this on for Apps, Books and Music. It is under Settings, iTunes and App Store. Check this on your phone and if it is on for apps you can turn it off and this way if you download an app

Look in iTunes media, mobile applications. There you will see all the apps you have backed up. You can also see the version number. I never delete any of the apps there as if a new version comes out and it isn't accessible, you can delete it from your phone by doing a double tap and hold.

Actually, Apple have been really good to me when it comes to refund for broken apps. Send an email to iTunesStoreSupport[at]apple[dot]com, tell them the app doesn't do what it say it does and to issue a full refund. They will refund you as an exception to the terms and conditions, which states
