Hello All,

I’m writing with a brief update; this afternoon, Judge Derrick K. Watson
granted the temporary restraining order [1], blocking the executive order
from enforcement nationwide. We are pleased with this result, and look
forward to the next stages of the case, when the court will examine the
order and its effects more thoroughly. We have updated the Foundation blog
to reflect the hearing’s outcome [2].

organizations, including Electronic Arts, Pinterest, and Zendesk, in
signing an amicus brief[1] that was filed in State of Hawaii v. Trump,[2] a
challenge to the new immigration-related executive order issued in the
United States.[3] This order was issued following legal challenges to a
previous executive order that instituted restrictions on immigration and
travel based upon national origin.[4]

The amicus brief was filed in support of an application for a temporary
restraining order,[5] which would prevent the executive order from going
into effect until legal challenges to its substance can be heard by a
court. It details how the order’s provisions would harm the operations of
the signatories, including the Wikimedia Foundation. As an organization
that collaborates across borders daily, with staff, contractors, and
members of the Wikimedia communities, these restrictions will hamper the
Foundation’s ability to work effectively in pursuit of our mission to make
free knowledge globally available.

[Wikimedia-l] Announcing the Foundation's challenge to recent U.S. immigration executive order

Dear All,

Today, the Wikimedia Foundation joined with more than 90 other
organizations in filing an amicus brief[1] in State of Washington v. Trump[2]
currently before the Ninth Circuit Court of Appeals of the United States.
This case challenges the recent executive order[3] issued in the United
States on January 27, 2017, which establishes immigration and travel
restrictions based on country of origin. Other signatories to the brief
include Facebook, Levi Strauss & Co., Microsoft, Mozilla, and Paypal. The
brief includes legal arguments against the order itself, and details the
real and immediate impact these restrictions will have on the Wikimedia
Foundation and other signatories’ staff, users, customers, and operations.
We expect it to be filed in other current and future cases challenging the
order, as appropriate.

We know that the Foundation’s prior statement[4] on this executive order
has generated debate in the communities, on mailing lists and in other
forums. Some disapprove, with concern that the Foundation has taken a
political stance on behalf of the movement. Others approve, with concerns
about the impact of this order on the practicalities and values of open
collaboration and sharing. We would like to clarify our perspective on this
important issue.

From our perspective, the implications of this order - and the urgency of
our response - are clear. Beyond the issue of the values of open
collaboration, this order will also have serious, tangible effects on the
Foundation and our ability to support the Wikimedia projects and
communities.

From an operational standpoint, orders such as these may substantially
limit our ability to deliver on support for the global Wikimedia
communities. Much of the Foundation's work involves travel across borders.
We cross borders to develop and sustain strategic partnerships with
Wikimedia affiliates and free knowledge advocates. We travel to gatherings
and hackathons to support and collaborate with Wikimedians around the
world. We represent Wikimedia research and methodologies at conferences
with librarians and scientists from across the globe. We meet with
community leaders and board members internationally to exercise corporate
and community governance and execute strategic oversight.

As the Foundation, we have an obligation to protect the Wikimedia projects
and ensure that they thrive in perpetuity. We are not a political
organization, but we are passionate about defending free knowledge, and the
conditions for its flourishing. We believe that the immigration and travel
restrictions posed by the executive order in question will have a
detrimental impact on the Foundation's mission and operations, as people
are unable to enter the United States or restricted from leaving because
they may not be allowed to return home. Board and committee meetings,
conferences, conventions, hackathons, and more may be affected by the
executive order in its current form, as well by the threatened extension of
restrictions to additional countries.

It is our obligation to engage with issues that affect the Wikimedia
Foundation's capacity to support Foundation’s mission and the goals of the
Wikimedia movement. From freedom of expression to freedom of movement, we

[Wikimedia-l] Advertising in Central Notice

Hi All,

Apologies for any confusion with the "powered by" language. The purpose of
the language was not, in any way, intended to provide advertising or
endorsement of the survey provider. The reasoning behind this language was:
(1) brevity given limited space; (2) notice to survey takers and link
clickers that they would be taken to a non-Wikimedia site; and (3)
transparency about the survey provider that we are using for that
particular survey and an easy link to that provider's privacy terms so that
users could make an educated decision about their own privacy. We are more
than happy to use alternate language that achieves those purposes.

Regarding why we don't use LimeSurvey - we actually used to use LimeSurvey
years ago. However, if I recall correctly, there were some major security
and scalability issues discovered and Tech decided it would be best to shut
the server down. That is when we started exploring use of third-party
survey providers like Qualtrics.

The research team did speak to me prior to beginning this project to ensure
that they complied with the WMF privacy policy. It is my view that this
type of use falls within the permissible potential uses for email addresses
under the policy. The examples listed in the policy are meant to be
illustrative, not exclusive -- the absence of this situation as an
enumerated example shouldn't be taken as a prohibition.

That said, it is a new use and therefore, will and should be the subject of
discussion and debate. It is such feedback and testing that will help us
refine email practices to be both effective and reflective of community
values.

 3. Wouldn't talk pages be a more appropriate outreach method than bulk
 email?

addressing the community's justified concerns. We believe that the
surveillance methods being employed by the NSA under the authority of the FISA

We would also like to update you on some news regarding the right to be
forgotten. The right to be forgotten has been the subject of much
discussion and debate, within the Wikimedia movement and throughout the
world, particularly following the May European Court of Justice judgment
http://eur-lex.europa.eu/legal-content/EN/ALL/?uri=CELEX:62012CJ0131
ordering Google to delist some links related to a Spanish citizen. Since
then, search engines have been receiving requests to remove hundreds of
thousands of URLs from search results. Google recently released more
information

about its right to be forgotten requests.

Since the judgment, the WMF legal team has been watching the “right to be
forgotten” issue closely and considering what legal strategies we should
take going forward. Over the course of the last week or so, we have
received our first five notices from Google advising us that over 50 links
to Wikimedia sites were to be removed from search results.


Today, WMF held a press briefing announcing our strategy of advocacy and
transparency on link censorship. We will oppose what we see as a misguided
court decision that has resulted in a crude implementation of the “right to

While this case is not binding precedent (Italy follows civil law), it is a
great case that other courts can look to in evaluating the liability of
chapters or other volunteers (who are not involved in the creation of the
content in question) sued for their alleged responsibility over content.

It is worth noting (as I did in the blog post), however, that every
individual is legally responsible for his or her actions both online and
off. For your own protection, you should exercise caution and avoid
contributing any content to the Wikimedia projects that may result in
criminal or civil liability under the laws of the United States or any

I would like to direct your attention to a new blog post (available on

about updating our current privacy policy.  Our privacy policy has not been
updated since 2008, and we believe it is time to revisit the policy to
ensure that it reflects where the Projects are today and where they have
the potential to go in the future.

It is important to us that the new policy reflects community values, so we
are asking for Wikimedia community input throughout this process.  We would
like to hear from

the next month about the privacy issues that matter to you.  Once we
have completed a draft of the new privacy policy (with the input we receive
