[Wikimedia-l] Re: Urgent attention required because Commons is blocked in Pakistan

Hi all,

I am Stephen LaPorte, the General Counsel at the Foundation.

We have received reports that Wikimedia Commons has been partially
inaccessible in Pakistan—depending on the user's Internet Service
Provider—for multiple years, starting as early as 2021. My understanding is
that it does not affect the display of images on Wikipedia, and it predates
the blocking and unblocking

of Wikipedia in February 2023.

We have not received any formal notice or a recent legal demand related to
Wikimedia Commons, so we do not know on what grounds the site is partially
inaccessible or how many people have been affected since this started.
Overall, traffic to Wikimedia Commons from Pakistan before 2020 is too low
to establish a clear pattern that shows when this started or the extent of
the disruption. All these factors have made understanding the situation
difficult and require a balanced response, and we remain committed to
knowledge access in the country.

not being able to access the site last year, we investigated further. We've
shared information about this situation with other organizations that
monitor internet censorship and advocate for internet freedom in Pakistan.

We believe that access to knowledge is a human right, and we oppose
internet censorship in all forms. We believe that limiting access to
projects like Wikimedia Commons deprives people of access to important
historical and educational content and makes it more difficult for local
volunteers to share their media with the world.

report this directly to the Wikimedia Foundation at 
and we can help route the question to the right technical experts within
the Foundation.

The war in Gaza and Israel and the danger it has posed and continues to
pose for community members is of deep concern. We are examining ways to
support our communities and any threats to our projects as it continues. We
wanted to provide you with an update on these efforts and direct your

consistently refining our safety and security plans. Proactively, we

and ensuring them of our availability to assist through the Human Rights
and Trust and Safety Teams with issues where we can support.

identified in the past, we have connected with local functionaries to
discuss approaches and are ready to do so again if such coordinated
activity is detected in relation to this crisis. Maintaining vigilance
against any coordinated efforts to manipulate information on Wikimedia
projects is a collective responsibility shared by both the Foundation and
Wikipedia's dedicated volunteers.

Hello Andy,

The Foundation is undertaking several initiatives in assisting the
Wikimedia communities in Ukraine and Russia, and in reviewing the potential
impacts that the sanctions will have on the movement. We are not able to
discuss all the specifics without potential risk to those being supported.

What we can disclose is that the Trust and Safety and Human Rights units of
the Foundation are in constant communication with community members in
Ukraine and Russia. Our Disinformation Team on the other hand is actively
collaborating with various communities in monitoring the situation, and in
ensuring that the projects maintain neutrality during these unprecedented
times.

Other emails on this thread have shared valuable ideas of how we can
collectively assist the Wikimedia communities in Ukraine and Russia, and we
are grateful for that. As we continue to monitor the situation, we urge
everyone to report direct threats of harm through our dedicated channel:
emerge...@wikimedia.org, so that we can evaluate them on an individual
basis and determine the best course of action.

We share your concern for the ongoing threats to our community members in
Ukraine and Russia, as well as our global mission to share free and open
knowledge. As Ziko just shared, the Foundation issued a statement

earlier today on the crisis in Ukraine. We will continue to connect with
our communities in the area and monitor for any cyber attacks or threats of
disinformation.



Earlier today, the Wikimedia Foundation received a letter from Roskomnadzor
asking for removal of an article on Russian Wikipedia about the Russian
invasion of Ukraine. Wikimedia Russia also has a copy of this letter and
has shared it on the Russian Wikipedia village pump. We appreciate the
effort of the many editors working in this area to ensure that Wikipedia
has high quality content, and we are currently reviewing what our options
are to challenge the request.

country-by-country fundraising data.

We make fundraising decisions, including decisions about what information
we release, based in part on our internal legal assessments in the country.
We don't go into our legal assessments publicly, as it may make it
difficult to keep legal risks and costs low.

We strive to be as open about our fundraising activities as we can.
Compared to nonprofit industry standards, we release more information than
other non-profits tend to, including continent-level breakdowns of
donations, information about revenue channels and testing, and reports from

Hello Pine,

Although we cannot commit to a systematic 14-day response time for all
inquiries, I do think that would be reasonable for routine inquiries,
depending on the amount of collaboration outside of the legal department.
As mentioned, AffCom is independent from the legal department, so I cannot
make a commitment for them, but AffCom has made a few recent changes that
aim to improve the process for user groups overall. I think that the legal
team does respond well within 14 days for the vast majority of inquiries
that we receive, and we will reemphasize the importance of this point with
our attorneys at our next biweekly legal meeting.

The legal team does not publish our quarterly goals because we do not want
to show our strategy to adverse parties, such as cases where we litigate to
defend WMF or to support the defense of users. That said, our public goals
are linked to standard ongoing workflows, much of which you can find in the
WMF's FDC proposal (

I am happy to speak with you specifically about turn-around time, so that
we get your question resolved quickly and find solutions that may improve
the process for others.

Overall, we try to be quite responsive. In cases that do take time, it is
likely because there are unusual circumstances that require background work
or internal and community coordination, and we may need to triage and
prioritize appropriately given our resources and other factors. I am not
sure that a 14-day turn around timeline makes sense for all cases. In
legal, we handle a range of other portfolios with a high level of
complexity, so this would result in some variance. Sometimes our responses
may take longer than we like, but I think our turn around time is often
much shorter than 14 days for most standard questions. Movement role
questions often require time for coordination with various stakeholders
internally and externally, and that may add to the response time as well.

disclosure of paid editing. This follows the extensive discussion of the

[Wikimedia-l] [Wikimedia Announcements] Optional changes to the Terms of Use amendment on undisclosed paid edits

Hello,

In response to some community comments on the proposed amendment to the
Terms of Use on undisclosed paid edits, the WMF's LCA team has suggested
two optional changes to the scope of the amendment. The aim is to address
concerns regarding reactions against editors who are suspected of violating
the disclosure requirements, and protecting good-faith contributors (such
as professors, students, and Wikipedians in Residence). These options are
not mutually exclusive - both of them, either, or neither could be adopted,
depending on your input.

These new options are available in English, Spanish, French, German,
Italian, and other languages.

The community's decision to blackout a project would not be within
this guideline, but any additional WMF resources would require legal
and financial review. There are strict laws in the U.S. that limit
when a non-profit organization may engage in political and legislative
activity, and it is the General Counsel and CFA's duty to ensure that
the WMF complies with those laws. The community has procedures for
determining consensus for action, and most of the time the community
can implement that action without any additional resources from the
WMF.
